RESOLUTION 09-227
APPROVAL OF PROCEDURES FOR THE SALE OF CITY -OWNED
PROPERTY KNOWN AS CLAYTON COMMONS PLAT 1 LOTS 1-9,WAUKEE,
DALLAS COUNTY,IOWA.
IN THE NAME AND BY THE A UTHORlTY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Iowa,is a duly organized municipality within Dallas
County;AND,
WHEREAS,the City Council has directed City staff to pursue the sale of city-
owned property at known as Clayton Commons Plat 1,lots 1-9,Waukee,Dallas
County,Iowa,subject to any and all covenants,restrictions and/or easements of
record;AND,
WHEREAS,the sale or potential sale of city property must conform with §364.7 Code
of Iowa,which requires the council to set forth its proposal to sell in a resolution and
publish notice of the resolution and of a date,time and place of public hearing on the
proposal;AND,
NOW THEREFORE BE IT RESOLVED by the City Council of the City ofWaukce,
Iowa on this the 2nd day of November,2009 that it hereby directs the City Administrator!
Clerk to publish notice of the solicitation of offers for city property at known as Clayton
Commons Plat 1,lots 1-9,Waukee,Dallas County,Iowa,subject to any and all
covenants,restrictions and/or easements of record.The notice of solicitation shall also
provide:
•The City will set the minimum offer per lot at $44,100.
•All offers will follow a sealed offer process.
•Each interested buyer must submit a separate offer for each lot they wish
to make an offer on.
•All offers must be on a f01111that is supplied by the City and submitted to
the City in a sealed envelope.
•Offers must be delivered to the Waukee City Clerk's Office by 2:00 PM,
December II,2009.
•Offers will be opened On December 11,2009,at 2:00 PM at City Hall.
•Offers must be valid for 60 days after the offer opening date.
•The City Council may take action at any time within that 60-day period.
•The City Council has the right not to accept any or all offers received.
•The City Council may wave any irregularities.
•If any offer is accepted by the City Council,such acceptance will be
contingent upon 10%earnest money being submitted to the City Clerk by
the Buyer within 20 days after the City Council accepts the offer.
BE IT FURTHER RESOLVED that December 11,2009 at 2:00 PM shall be set as the
date for receipt of offers therefore and that December 21,2009 shall be set as the date for
public hearing to consider the proposals/offers received for the purchase of such property.
Notice of said hearing shall be published as required by Iowa Code 364.7 (2009).
Thereafter the Council may take any action it deems appropriate relative to the sale of
such property by resolution.
