RESOLUTION 09-237
APPROVING THE FINAL PLAT FOR
WAUKEE GREENWAY PARK PLAT 1
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,Philip E.Broderick,LLC and Charlotte R.Broderick,LLC (the "Developer")has
requested [mal approval of Waukee Greenway Park Plat 1 (the "Plat");AND
WHEREAS,the City of Waukee Planning and Zoning Commission recommended approval of
the Plat on October 13,2009;AND,
WHEREAS,the Developer has filed with the City of Waukee a Declaration of Easement,
Covenants and Conditions for Waukee Greenway Park Plat 1 to be recorded with the Plat
therefore;AND,
WHEREAS,the Final Plat fOTWaukee Greenway Park Plat 1 and the documents relating thereto
comply in all respects with Section §303 -Land Subdivision Ordinance ofthe Waukee
Municipal Code;
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Waukee,Iowa
on this 16th day of November 2009 that the Final Plat fOTWaukee Greenway Park Plat 1 be and
the same is hereby accepted and approved by the City Council of the City of Waukee subject to
final review and approval of the legal documents by the City Attorney.
BE IT FURTHER RESOLVED that the City of Waukee does hereby accept the following
additional easements to be filed with the Plat subject to final review and approval by the City
Attorney:
1.Easement fOTPublic Utility;
2.Easement for Public Storm Sewer;
3.Easement for Public Ingress/Egress,Public Improvement,Public Utility and
Sanitary Sewer;
4.Easement for Grading,Detention and Overland Flowage.
BE IT FURTHER RESOLVED that the City of Waukee does hereby accept the Declaration of
Easement,Covenants and Conditions (collectively,the "Covenants")fOTthe Plat subject to final
review and approval by the City Attorney and the City Clerk is directed to file such Covenants
with the Plat.
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to file the
final plat of Waukee Greenway Park Plat 1,as well as any other documents related thereto,with
the Dallas County Recorder.
