RESOLUTION 08-147
APPROVING AN AMENDMENT TO THE AGREEMENT PURSUANT TO IOWA
CODE CHAPTER 28E BETWEEN THE CITY OF WAUKEE,IOWA AND THE CITY
OF WEST DES MOINES,IOWA FOR THE PROVISION OF INFORMATION
TECHNOLOGY SUPPORT SERVICES
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,a 28E agreement between the City of Waukee and the City of West Des Moines for
the provision ofinfonnation teclmology support services was approved by the Waukee City
Council on July 12,2004 (Resolution #04-156)and a second 28E agreement for the continuation
of such services was approved by the Waukee City Council on August 29,2005 (Resolution #05-
157);AND,
WHEREAS,the 28E agreement approved in 2005 will expire on June 30,2008;AND,
WHEREAS,the City of Waukee Attorney has drafted an amendment to the agreement as
follows:
•extend the terms of the agreement to 11:59 p.m.on August 31,2008;
•provide that Waukee shall pay $7,284.83 to West Des Moines for services under the
extended term;and
•that unless otherwise extended by both parties in writing,the agreement shall terminate
on 11:59 p.m.on August 31,2008.
WHEREAS,the obligations and duties arising from this agreement will be honored by each
community,one to the other,as appropriate.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
16th day of June 2008 that it hereby approves,pursuant to Chapter 28E of the Iowa State Code,n
amendment to the agreement with the City of West Des Moines for the provision ofInformation
Technology Support Services.
