RESOLUTION 08-176
APPROVING THE SITE PLAN FOR LOT 9 OF
WESTGATE BUSINESS PARK PLAT 2
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized
Municipal Organization;AND,
WHEREAS,the City of Waukee Planning and Zoning Commission approved the Site
Plan for Lot 9 of Westgate Business Park Plat 2 on June 24,2008;AND,
WHEREAS,the Site Plan for Lot 9 of Westgate Business Park Plat 2 is in general
conformance with §304 -Site Plan Ordinance of the Waukee Municipal Code;
WHEREAS,in the future,a ten (10)foot concrete bike trail will be installed along the
north property line of Lot 9 of Westgate Business Park Plat 2 and the property owner
has signed a development agreement and provided payment for the cost of construction
of the bike trail attributable to Lot 9 of Westgate Business Park Plat 2;
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,
Iowa on this 21 s day of July 2008 that the Site Plan for Lot 9 of Westgate Business Park
Plat 2 is approved.
BE IT FURTHER RESOLVED that the City of Waukee does hereby accept the
Development Agreement and payment related to the future concrete bike trail.
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed
to file the Development Agreement,as well as any other documents related thereto,
with the Dallas County Recorder.
