RESOLUTION 05-150
APPROVING THE XENIA RURAL WATER DISTRICT PURCHASE
AGREEMENT
WHEREAS,Xenia owns,operates and maintains a rural water system to provide water
to persons located in Dallas,Polk,Boone,Story,Greene,Guthrie,Hamilton,Webster,
and Adair Counties (the "Water System").As part of its Water System,Xenia has
constructed,installed and maintains a potable water line within an area adjacent to the
City;AND,
WHEREAS,the City desires to acquire from Xenia the Purchase Area System on and
subject to the terms and conditions of the Purchase Agreement to serve,supply and bill
water users and customers located in the Purchase Area subject to the terms and
conditions outlined in the purchase agreement;AND,
WHEREAS,the City and Xenia entered into an agreement dated December 20,2004,for
the sale and purchase of a portion of the Purchase Area System,but which transaction has
not been COnSlU11l11ated;AND,
WHEREAS,the parties desire that this Purchase Agreement supersede and replace said
December 20,2004,agreement,
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,
Iowa that the Xenia Rural Water District Purchase Agreement be approved.
Passed by the City Council of the City of Waukee,Iowa,and approved the 15th day of
August 2005.
