RESOLUTION 05-161
APPROVING THE REVISED PRELIMINARY PLAT FOR
PAINTED WOODS PLATS 2 &3
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized
Municipal Organization;AND,
WHEREAS,the City of Waukee Planning and Zoning Commission approved the
Preliminary Plat for Painted Woods Plats 2 &3 on August 23,2005;AND,
WHEREAS,the developer needs to provide the City of Waukee with a written
agreement addressing the parkland dedication,AND,
WHEREAS,the developer or assignees,will provide a written request to the City to
initiate the installation of the future improvements by increasing the pumping capacity as
required to convey the increased wastewater flows due to development of the land,AND,
WHEREAS,the Painted Woods developer agrees to pump and haul any waste in a
timely manner until the regional pump station is completed and operational,AND,
WHEREAS,the Preliminary Plat for Painted Woods Plats 2 &3 is in general
conformance with section §303 -Land Subdivision Ordinance of the Waukee Municipal
Code;and
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,
Iowa that the revised Preliminary Plat for Painted Woods Plats 2 &3 be approved subject
to the developer's written agreement concerning parkland dedication and adhering to the
conditions otherwise specified in the resolution.
Passed by the City Council of the City of Waukee,Iowa,and approved the 29th day of
August 2005.
