RESOLUTION 05-188 ]
APPROVING STORM SEWER EASEMENT WITH
DARYL L.PETERSEN AND SUSAN C.PETERSEN
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,during construction of homes within an area of the Windfield Development,sump
lines running from the sump pumps in the homes to the storm sewer were not installed resulting
in extensive ponding in the area;AND,
WHEREAS,the City has agreed to install sump lines in order to drain the ponding areas into the
storm sewer;AND,
WHEREAS,City staff would like to secure for the consideration of the sum of One Dollar
($1.00)a permanent and perpetual Storm Sewer Easement upon,over,under,through and across
the south 10 feet of Lot 42,Windfield Plat 1 currently owned by Daryl L.Petersen and Susan C.
Petersen;AND,1WHEREAS,the easement has been reviewed by city staff,Veenstra &Kimm,Inc.and the City
Attorney Steve Brick and no discrepancies were noted.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
3rd day of October 2005 that it hereby approves the StOlIDSewer Easement with Daryl L.
Petersen and Susan C.Petersen.
