RESOLUTION 05-236 I
APPROVING THE SECOND ADDENDUM TO TELECOMMUNICATIONS SPACE
LEASE ENTERED INTO WITH THE WAUKEE COMMUNITY SCHOOL DISTRICT
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee and Waukee Community School District entered into a
telecommunications space lease agreement on the 24th day of August 2005,in which the term of
the lease extended to November 1,2005;AND,
WHEREAS,On November 7,2005,the City of Waukee extended the lease agreement until
November 30,2005;
WHEREAS,the Waukee Community School was unable to get the antennae removed and reset
on the West Des Moines Water Tower before the expiration of the agreement date of November
30,2005;AND,
WHEREAS,the City of Waukee will extend the Telecommunications Space Lease Agreement
term until May 31,2006 at which time if the antennae has not been removed from the water
tower,the City will charge the School rent beginning June 1,2006 until such a time that the
antennae is removed.I
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
19th day of December 2005 that it hereby approves the Addendum to Telecommunications Space
Lease;AND,
BE IT FURTHER RESOLVED by the City of Waukee City Council that nothing herein is
intended to modify the remaining terms of the original lease and should not be construed as
modifying any other term or provision thereof.
