RESOLUTION 08-150
RESOLUTION VACATING THE PUBLIC UTILITY EASEMENT FOR THE
DISTRICT REGULATOR STATION
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,a public utility easement for a district as regulator station was dedicated to the City
upon the platting of certain land known as Williams Point plat 7,located within the City of
Waukee,Iowa;AND
WHEREAS,City Staff had determined that they desire to locate the gas district regulator in
another area of the property and acquired an easement for the same.Therefore,no public
infrastructure will be located within the Public Utility Easement described as:
PART OF LOT 1,WILLIAMS POINTE PLAT 7
THE SOUTH 10.00 FEET OF THE NORTH 40.00 FEET OF THE EAST 135.00 FEET OF
THE WEST 165.00 FEET OF LOT 1 AND THE EAST 10.00 FEET OF THE WEST 40.00
FEET OF THE SOUTH 20.00 FEET OF THE NORTH 60.00 FEET OF SAID LOT 1,ALL
BEING IN WILLIAMS POINTE PLAT 7,AN OFFICIAL PLAT IN THE CITY OF WAUKEE,
DALLAS COUNTY,IOWA.;AND
WHEREAS,after publication of notice of hearing as required by law,a public hearing was held
concerning the vacation of the Public Utility Easement described herein on this the 7'h day of
July,2008,and after hearing,the City Council of the City of Waukee,Iowa finds there is no
further public need for the easement described herein and the same should be vacated.
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Waukee that the
Public Utility Easement described as:
PART OF LOT 1,WILLlAMS POINTE PLAT 7
THE SOUTH 10.00 FEET OF THE NORTH 40.00 FEET OF THE EAST 135.00 FEET OF
THE WEST 165.00 FEET OF LOT I AND THE EAST 10.00 FEET OF THE WEST 40.00
FEET OF THE SOUTH 20.00 FEET OF THE NORTH 60.00 FEET OF SAID LOT I,ALL
BEING IN WILLIAMS POINTE PLAT 7,AN OFFICIAL PLAT IN THE CITY OF WAUKEE,
DALLAS COUNTY,row A.
should be and the same is hereby vacated.
