RESOLUTION 05-98
APPROVING PAYMENT OF RETAINAGE TO C.L.CARROLL CO.,INC.
FOR THE CONSTRUCTION OF WAUKEE PUMP STATION 1,3 AND 6
IN THE AMOUNT OF $6,088.65
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,C.L.Carroll submitted the low bid for the construction of Waukee Pump Station 1,
3 and 6 and was awarded the contract on August 16,2004;AND,
WHEREAS,Brad Freeman,Engineering Technician has reviewed the work and in his letter
dated April S,2005 approved the Final Payment;AND,
WHEREAS,the Final Partial Payment Estimate (No.4)was approved for payment during the
April 18,2005 council meeting;AND,
WHEREAS,the Certificate of Completion and acceptance of the proj ect by the City were
approved on the 16th of May,2005;AND,
WHEREAS,the State ofIowa Code,§573.13 and §573.14 state that funds not exceeding 5%of
the contract price shall be withheld from payment and shall be retained for thirty days beyond the
date of final acceptance of the improvement;so that funds will be available for the payment of
claims for materials furnished and labor performed on the improvements.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
20th day of June 2005 that it hereby approves payment of retain age to C.L.Carroll Company,
Inc.in the amount of $6,088.58.
