RESOLUTION 06-138
APPROVING AN APPEAL OF LUND MOTORS,395 ASHWORTH DRIVE,FROM THE
PROVISIONS OF WAUKEE MUNICIPAL CODE SECTION 803.2 (EE),REQUIRING AN
APPROVED AUTOMATIC FIRE EXTINGUISHING SYSTEM FOR REPAIR
GARAGES/SERVICE STATIONS OVER 3,500 GROSS SQUARE FEET
INTHENAMEANDBYTHEAUTHORITYOFTHECITYOFWAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,Lund Motors is constructing a 2,200 square foot addition to the existing 2,400 square
foot automotive repair garage at 395 Ashworth Drive;AND,
WHEREAS,in order to proceed with the remaining construction of the 2,200 square foot addition,
Lund Motors must be granted an appeal from the provisions of Waukee Municipal Code Sections
803.2(EE)which requires buildings used for repair garages/service stations over 3,500 gross square
feet be required to install an approved fire extinguishing system or a minimum two-hour fire wall in
lieu of the approved fire extinguishing system as allowed for in Section 705,Firewalls,of the 2003
International Building Code that has been adopted by the City of Waukee as Ordinance 80 I;
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,Iowa that
the appeal of Lund Motors,395 Ashworth Drive,from the provisions of Waukee Municipal Code
Sections 803 .2(EE)be approved.
Passed by the City Council of the City of Waukee,Iowa,and approved the 10th day of July 2006.
