RESOLUTION 05-120 ]
APPROVING THE FIVE-YEAR MORATORIUM AGREEMENT REGARDING THE
WAUKEE MIDDLE SCHOOL CONCESSION STAND/BATTING FACILITY
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized Municipal
Organization;AND,
WHEREAS,the Waukee Middle School Concession Stand/Batting Facility was originally
approved by the City Council of Wankee,Iowa on May 17,2004;AND,
WHEREAS,the facility was not constructed as approved by the City Council in that the colors
of the metal facing and roofing are not as approved;AND,
WHEREAS,a sub-committee of City ofWankee Planning and Zoning Commissioners,
representatives of the Waukee Community School District and City staff met on June 20,2005 to
discuss a possible resolution;AND,
WHEREAS,the sub-committee recommended to the City Council that a five-year moratorium
be imposed beginning on the date of approval of this resolution,by which time the structure must
be modified to meet the requirements of the site plan approved by the City Council on May 17,
2004 OR be part of an over-all Waukee Middle School remodeling,which would include a
revised Site Plan for the Concession Stand /Batting Facility;AND,
WHEREAS,the City of Wankee Planning and Zoning Commission approved the sub-committee
recommendation for the Waukee Middle School Concession Stand/Batting Facility on June 28,
2005;
NOW THEREFORE BE IT RESOLVED by the City Council of the City ofWankee,Iowa
that the five-year moratorium agreement for Waukee Middle School Concession Stand/Batting
Facility be approved.
Passed by the City Council of the City of Waukee,Iowa,and approved the 11th day of July
2005.
