RESOLUTION 06-150
APPROVING A SURFACE WATER FLOWAGE EASEMENT(S)CONVEYED FROM
WARREN AND JODI PAGE TO THE CITY OF WAUKEE,IOWA
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,Darron Dunn of 220 Linden Drive wishes to construct an in-ground swimming
pool on his property within an area designated as a surface water flowage easement;AND,
WHEREAS,to facilitate the approval of a swimming pool building permit for Mr.Dunn,
Warren and Jodi Page ono Windfield Pkwy.have consented to the relocation of a portion of the
surface water flowage easement onto their property;AND,
WHEREAS,City staff agrees to secure for the consideration of the sum of One Dollar ($1.00)a
permanent and perpetual Easement for Surface Water Flowage and right-of-way upon,over,
under,through and across the east fifteen (15)feet of Lot I in Windfield Plat 2,which adjoins
the west fifteen (15)feet of Lot 14 in Windfield Plat 3,both official plats,now included in and
forming a part of the City of Waukee,Dallas County,Iowa;AND,
WHEREAS,the easement has been reviewed by city staff,Veenstra &Kimm,Inc.and the City
Attorney and no discrepancies were noted.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
24th day of July 2006 that it hereby approves the Surface Water Flowage Easement(s)from
Wan-en and Jodi Page.
