RESOLUTION 05-136
APPROVING 28E AGREEMENT WITH THE OFFICE OF RIGHT OF WAY OF THE
IOWA DEPARTMENT OF TRANSPORTATION FOR RIGHT OF WAY ACTIVITIES
NECESSARY FOR THE EXPANSION AND IMPROVEMENT
OF UNIVERSWITY AVENUE FROM WACO PLACE TO WEST OF
ALICE'S ROAD,PROJECT NO.STP-U-8177(605)-70-25
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,pursuant to Chapters 307,330 and 28E of the Code,the Office of Right of Way of
the Iowa Department of Transportation (the "Department")has proposed to provide:
(1)Appraisal Services at a rate of $150 per parcel for up to ten parcels and
(2)Acquisition Services at a rate of $1,000 per parcel for up to ten parcels;AND,
WHEREAS,the Department will operate according to the following objectives and
responsibilities:
(1)The Department shall perform its right of way activities in accord with the standards
oflaw at1d policy contained in paragraph 1,"Purpose"ofthe 28E Agreement;
(2)The Department shall provide Appraisal Review and Acquisition services as required
by law;
(3)Upon completion of the Appraisal Review ofthe parcels,the Department shall advise
the City of its determination of fair and just compensation;
(4)The Department shall advise the City of all counter proposals received during
negotiations and secure prior approval from the City for all Administrative
Settlements;
(5)The Department shall provide periodic status reports to the City and maintain
complete records.The Department shall provide the final records to the City;AND,
WHEREAS,City staff have reviewed the 28E Agreement with the Department and recommend
its approval.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
1st day of August 2005 that it hereby approves the 28E Agreement with the Office of Right of
Way of the Iowa Department of Transportation for the expansion and improvement of University
Avenue from Waco Place to west of Alice's Road.
