HomeMy WebLinkAbout2006-08-07-Resolutions 06-155_Sidewalk Improvements 2004-2005 - Res of NecessityRESOLUTION 06-155 RESOLUTION OF NECESSITY WHEREAS,the City Council of the City of Waukee,Iowa,has adopted preliminary resolutions in accordance with Section 384.42 of the Code of Iowa,for the construction of sidewalks to be paid by special assessment in accordance with the 2004 and 2005 sidewalk improvement programs (the "Project");and WHEREAS,pursuant thereto,the City Engineer has prepared preliminary plans and specifications,an estimated total cost of the work and a plat and schedule,including the valuation of each lot as determined by this Council,and the same have been duly adopted and are now on file with the City Clerk. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,Iowa: Section 1.It is hereby found and determined to be necessary and for the best interest of the City and its inhabitants to proceed with the Project,and to assess a portion of the cost to the properties benefited thereby,and the Property Owners have submitted Petitions and Waivers that were previously accepted by the City in accordance with §384.41(l)Code ofIowa. Section 2.The Project shall consist generally of the construction of portland cement concrete sidewalks,four feet wide and four inches thick,on the following properties: 1.650 2nd Street 2.660 2nd Street 3.230 Ashworth Drive 4.130 3'd Street 5.80 Ashland Court 6.170 Bel Aire Drive 7.130 Bel Aire Drive 8.30 Windfield Parkway and that said properties on which sidewalks will be constructed will be benefited by this improvement and should be specially assessed. Section 3.It is hereby found and determined that there are now on file in the office of the City Clerk an estimated total cost of the proposed work and a preliminary plat and schedule showing the amount proposed to be assessed to each lot by reason ofthe Project. Section 4.Unless a property owner files objections with the City Clerk at the time of the hearing on this resolution of necessity,the property owner shall be deemed to have waived all objections pertaining to the regularity of the proceedings and the legality of nsing the special assessment procedure. Section 5.All resolutions,parts of resolutions,or actions of the Council in conflict herewith are hereby repealed,to the extent of snch conflict.
