RESOLUTION 06-168
APPROVING THE SITE PLAN EXTENSION FOR LEGACY POINTE VILLAGE
CENTER
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,the Waukee City Council approved the Site Plan for Legacy Pointe Village Center
on September 19,2005;AND,
WHEREAS,the approved site plan will become null and void on September 20,2006,as a
building permit has not been approved and actual construction has not begun prior to this date;
AND,
WHEREAS,the developer has applied for a one (I)year extension of the site plan in
accordance with Waukee Municipal Code §304.9(B);AND,
WHEREAS,the Planning &Zoning Commission recommended the extension be approved
during the meeting of August 8,2006;AND,]
WHEREAS,the Site Plan for Legacy Pointe Village Center remains in general conformance
with §304 -Site Plan Ordinance of the Waukee Municipal Code,as well as the Arterial Corridor
Overlay District;
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,Iowa in
session this 21 st day of August 2006 that a one-year extension for the site plan for Legacy Pointe
Village Center is approved.
