RESOLUTION 06-172 I
RESOLUTION AUTHORIZING CERTAIN ACTIONS NECESSARY FOR THE
PRELIMINARY DEVELOPMENT OF A SPORTS COMPLEX BY THE CITY OF
WAUKEE
INTHENAMEANDBYTHEAUTHORITYOFTHECITYOFWAUKEE,IOWA
WHEREAS,the City of Waukee owns certain ground which it intends to develop for use
as a sport complex;AND,
WHEREAS,other adjacent ground is being acquired by the City of Waukee pursuant to
an option agreement;AND,
WHEREAS,the City desires to undertake the actions necessary for the ultimate
development of the land as a sports complex for use by the public;AND,
WHEREAS,the land titled in the City is currently subject of a farm tenancy which must
be terminated prior to work being undertaken,
BE IT THEREFORE RESOLVED by the City Council of the City of Waukee on this the
28th day of August 2006 that the farm tenancy between J.Harry Copeland and the City of
Waukee should be terminated and the Mayor is authorized to execute any and all
documents necessary to terminate said tenancy.
BE IT FURTHER RESOLVED that the public works director is authorized to undertake
grading and seeding work on the property owned by the City upon the conclusion of the
farm tenancy.
BE IT FURTHER RESOLVED that the City Attorney's office is authorized to institute
legal proceedings as it deems necessary to compel the parties to the option agreement,and
title holders to the land which is the subject of said option agreement,to honor the terms
and conditions of the option agreement and acquire the property on which the option has
been exercised by the City.
