HomeMy WebLinkAbout2006-09-25-Resolutions 06-161_Cable Broadcast Policy - GuidelinesROLL CALL VOTE Donald L.Bailey,Jr. Isaiah McGee Jeff Mertz Darlene Stanton Mike Watts AYE X NAY ABSENT X X X X THE CITY OF WAUKEE,IOWA RESOLUTION 06-191 APPROVAL OF THE WAUKEE BROADCAST SYSTEM CABLE CHANNEL 7 POLICY AND GUIDELINES IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA WHEREAS,the City of Waukee,Iowa,is a duly organized municipality within Dallas County; AND, WHEREAS,in September 2002,the City began the broadcast of live and taped programs and community billboards oflocal governmental activities and other events of value and interest to the community at large;AND, WHEREAS,the City has previously operated Waukee Broadcast System Cable Channel 7 without an official policy or guidelines for community submittals and broadcasts;AND, WHEREAS,it is in the best interest of the City at this time to approve and adopt the Waukee Broadcast System Cable Channel 7 Policy and Guidelines,which is attached hereto and by tills reference is incorporated herein. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,Iowa on this the 25th day of September 2006 that the Waukee Broadcast System Cable Channel 7 Policy and Guidelines is hereby approved. Attest: ROLL CALL VOTE Donald L.Bailey,Jr. Isaiah McGee Jeff Mertz Darlene Stanton Mike Watts AYE X NAY ABSENT X X X X WAUKEE BROADCAST SYSTEM CABLE CHANNEL 7 POLICY AND GUIDELINES POLICY STATEMENT: The local access cable channel of the City of Waukee (hereinafter known as "WBS Cable Channel 7")will provide access to taped or live programs and community billboards of local governmental activities,educational information and activities,and other events of value to the local connnunity through cable telecasts on cable channel 7 in accordance with the franchise agreement between Mediacom Cable TV and the City of Waukee. The idea is to provide govemmental and educational progrannning of high quality and local interest,utilizing to the fullest extent WBS Cable Channel 7 as provided under the agreement between Mediacom Cable TV and the City of Waukee. 1.GUIDELINES: 1.WBS Cable Channel 7 shall only be used by individuals or organizations that have been approved or authorized by the City of Waukee to utilize this form of communication.Programs and/or billboards promoting specific political, connnercial or religious topics,views,andlor entities shall not be permitted.Such organizations and activities approved or authorized by the City of Waukee shall include non-profit organizations,governmental events and activities,school- related or school-sponsored events and activities,general non-party-specific political announcements,and birthdays and anniversaries of individuals residing within the Waukee corporate limits. 2.Programs and/or billboards must promote activities that take place within the Waukee corporate limits and/or are sponsored by Waukee-based groups. Submittals from groups based outside of Waukee will not be considered. 3.Each submission for broadcast shall be reviewed by the System Coordinator and/or City Administrator. 4.The System Coordinator and/or City Administrator shall have the authority to, determine the specific times for broadcast or rebroadcast,and shall also have the authority to determine the order in which material is televised.Programs shall not be broadcast during times dedicated to governmental broadcasts or rebroadcasts. 5.The System Coordinator shall establish the format in which the material is to be received. 6.The System Coordinator shall have the authority to reject any submittal for broadcast based on poor or substandard video or audio quality. 7.Programs and/or billboards submitted for WBS Cable Channel 7 broadcast shall be provided to the System Coordinator at least five (5)working days before airing.When timeliness of a program is essential,the scheduling and advance tape submission time may be waived with approval of the System Coordinator and/or City Administrator. 8.The System Coordinator shall have the authority to edit billboards submitted for WBS Cable Channel 7 broadcast for length and clarity. 9.All programs submitted for broadcast must be labeled clearly with the name/type of program,date on which the program was taped,submitter,and total running time. 10.No program,production,presentation,or billboard shall include any material that violates any local,state,or national law. 11.WBS Cable Channel 7 shall not be used for any purpose other than the broadcast of governmental or educational programming,or programming deemed to be of community interest.Neither the equipment nor the services available through the City of Waukee are intended to be used for private or commercial gain,or in direct competition with local businesses which offer production services or video equipment rental to the public as their livelihood.Advertising of a for-profit business or enterprise,conducting or promoting of a lottery or other illegal enterprise,or offering of any product or service for sale on WBS Cable Channel 7 will be considered a violation of this policy.However,it is acceptable for a business or enterprise to "sponsor"or "underwrite"a program which meets the criteria established above,with the notation ofthe business or enterprise listed at the beginning and/or end ofthe program and/or billboard. 12.In the absence of any written agreement to the contrary,the rights to a WBS Cable Channel 7 program remain with the producer.However,the City of Waukee will retain the rights to use the program in the public interest for repeat broadcasts,promotions,and archival purposes.All video and audiotapes,except those purchased by the producer,remain the property of the City of Waukee.No program shall be aired that constitutes or contains copyrighted material without the specific written authorization of the holder of said copyright.In addition,prior to airing any program or billboard,the party submitting shall hold the city harmless from any and all liability in way related to the airing of any material on Channel 7 including any and penalties,damages and attomey's fees. 13.Video or audio copies of city council,board,commission or committee meetings shall be provided upon request,with at least twenty-four (24)hours notice.A $5.00 fee shall be charged for each copy. 14.Periodic changes to these policies and specific rules may be made from time to time as required. 15.The City of Waukee retains the right to refuse to air any program and/or billboard for any reason. 11.BILLBOARDS Billboards aired on channel 7 shall be in a stationary print format and contain no audio feedback.They shall be limited to a ten (10)second maximum and shall be broadcast once within each billboard playlist rotation for a maximum of 1 week. IlL PROGRAMS Non-governmental programs shall be limited to a thirty (30)minute maximum per group per day,with a maximum of two (2)hours per week,as playback time and capacity allows.The amount of capacity shall be determined by the system coordinator based on the governmental programming being aired in a given week.Available time,after deducting time being utilized for govemmental broadcasting,shall be allocated equally among any nongovernmental approved programming meeting these guidelines up to the maximum air time provided for herein.
