RESOLUTION 06-56
APPROVAL OF AN APPLICATION OF RICK AND MARCIA WANAMAKER FOR 710
SOUTHFORK DRIVE,WAUKEE,FOR AN APPEAL FROM WAUKEE STANDARD
SPECIFICATIONS FOR PUBLIC IMPROVEMENTS,SECTION 13.11-DRIVEWAY
APPROACH AND SIDEWALK CONSTRUCTION
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WA UKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,Rick and Marcia Wanamaker have constructed a single family home at 710 Southfork
Drive and wish to pave the driveway and approach with concrete paver bricks;AND,
WHEREAS,on December 5,2005,the City Council of Waukee had approved an appeal of the
Wannamakers from the provisions of Waukee Municipal Code Sections 301.27(C)(I)and
304.5(G)(1),which prohibits the use of any materials in a driveway other than Portland concrete
with a minimum thickness of five inches,or asphaltic concrete with a minimum thickness of five
and one-half inches (Resolution #05-223);AND,
WHEREAS,the Wannamakers also wish to use concrete paver bricks for the driveway approach in
the public right-of-way and so seek an appeal from the provisions of Waukee Standard
Specifications for Public Improvements,Section 13.11 -Driveway Approach and Sidewalk
Construction,which state that any portion of the driveway to be placed in the public right-of-way is
to be constructed to Waukee city standards,which is a minimum of six inch PCC;AND,
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,Iowa that
the appeal of Rick and Marcia Wanamaker,710 Southfork Drive,from the provisions of Waukee
Standard Specifications for Public Improvements,Section 13.11 -Driveway Approach and
Sidewalk Construction,be approved provided an agreement is executed between the City and the
property owner stating that the City will not be held liable for any damages to the brick pavers in
the public right-of-way;and if the City initiates the removal of any portion of the approach,the
property owner will be reimbursed for the equivalent cost of concrete only without labor,and will
be responsible for the removal and reinstallation of any pavers for construction by the City.
Passed by the City Council of the City of Waukee,Iowa,and approved the 3'd day f April 2006.

APPROVING A DEVELOPER'S AGREEMENT WITH GILCREST/JEWETT LUMBER
COMPANY AND WILLIAMS POINTE COMMERCIAL,L.C.FOR ROAD
IMPROVEMENT REIMBURSEMENT
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,the City is scheduled to begin construction on the widening and realignment of the
intersection of Alice's Road and University Avenue in 2006;AND,
WHEREAS,in order to maintain access to the abutting properties in the future when the City
shall undertake widening of Alice's Road further north of said intersection,Gilcrest/Jewett
Lumber Company and Williams Pointe Commercial I,L.C.have asked to undertake the
widening of Alice's Road north of said intersection as a private project;AND,
WHEREAS,a Developer's Agreement is proposed wherein the private parties shall undertake
and finance the private portion of certain Alice's Road street improvements,and the City shall
reimburse the private parties for the private portion of the costs over a 5-year period beginning
one year after the private parties have submitted an invoice to the City for the City's portion of
improvements;AND,
WHEREAS,the City shall undertake and finance the public portion of certain Alice's Road
street improvements,provided the private parties reimburse the City thirty (30)days after an
invoice is submittedby the private parties for the City's portion of the cost of improvements.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,Iowa in
session this 10th day of April 2006,that the Developer's Agreement for road improvement
reimbursement be approved,provided the interest on payments made to the private parties shall
be 0%and City staff shall pursue options to complete reimbursement payments more quickly
than the five-year period stated in the Agreement,if in the best interest of the City.I
