RESOLUTION NO.06-63 ]
TO FIX A DATE OF MEETING AT WHICH IT IS PROPOSED TO APPROVE AN
ORDINANCE ESTABLISHING THE SEWER TREATMENT CONNECTION FEE
DISTRICT PURSUANT TO SECTION 384.38 OF THE CODE OF IOWA
IN THE NAME AND BY THE A UTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,Section 384.38 of the Code ofIowa authorizes cities to establish by
ordinance connection fee districts and corresponding schedules of fees in order to allocate the
cost of improvements necessary to extend sewer service to properties within such a district;and
WHEREAS,pursuant to Section 384.38,the City of Waukee (the "City")has proposed to
establish the Sewer Treatment Connection Fee District (the "District")with a corresponding
schedule of connection fees,has prepared an ordinance for such purpose and it is now necessary
to set a date for a hearing on such proposal and to make provision for the publication of notice
thereof;
NOW THEREFORE,BE IT RESOLVED by the City Council of the City of Waukee,
Iowa,as follows:
Section 1.This Council shall meet on the 15th of May 2006,at 7:00 o'clock p.m.,at j
the Waukee City Hall,in the City,at which time and place proceedings will be instituted and
action taken to approve an ordinance establishing the Sewer Treatment Connection Fee District,
a copy of which has been placed on file in the office of the City Clerk.
Section 2.The City Clerk is hereby directed to give notice of the proposed action,the
time when and place where said meeting will be held,by publication at least once not less than
twenty days before said meeting in a legal newspaper of general circulation in the City.Said
notice shall be in substantially the following form:

TREATMENT CONNECTION FEE DISTRICT,PURSUANT TO SECTION 384.38 OF THE
CODE OF IOWA
The City Council of the City of Waukee,Iowa,will meet at the Waukee City Hall,on the
15th of May 2006,at 7:00 o'clock p.m.,at which time and place proceedings will be instituted
and action taken to approve an ordinance establishing the Sewer Treatment Connection Fee
District,as authorized by Section 384.38 of the Code of Iowa.A copy of said ordinance has
been placed on file in the office of the City Clerk.
The Sewer Treatment Connection Fee District shall serve to equitably distribute the costs
associated with the City's Sewer Treatment facility expansion and capacity expansion
acquisitions obtained by the City from the WRA necessitated by increasing capacity needs
resulting from new growth and development in order to extend sewer service to property owners
in the district seeking to connect to the municipal sewer utility.
The Sewer Treatment Connection Fee District shall include all real property within the
incorporated boundaries of the City of Waukee as of January 1,2006,and all real property in the
unincorporated areas lying within two miles of said boundaries.
Sewer Treatment Connection fees shall be due at the time of submission of a building
permit.Issuance of building permits and/or Mobile Home Permits shall not occur until such time
as any and all fees have been paid in full.
The fees are be based upon the equitable costs of extending sewer service to the
properties for which connection to the Municipal Sewer System is sought.The fees will increase
annually based on the following schedule to account for increased costs by the City for the Sewer
Treatment System capacity expansion and interest.From the effective date of this ordinance,
fees shall be imposed in the following amounts:

The City Council reserves the right to grant variances from this schedule of fees.
At the meeting,the Council will receive oral or written objections from any resident or
property owner of the City.Thereafter,the Council may,at the meeting or at an adjournment
thereof,take additional action to approve the ordinance establishing the Sewer Treatment
Connection Fee District.
This notice is given by order of the City Council of Waukee,Iowa,in accordance with
Section 384.38 of the Code ofIowa.
