HomeMy WebLinkAbout2006-11-06-Resolutions 06-217_Annexation - VariousTHE CITY OF WAUKEE,IOWA RESOLUTION 06-217 RESOLUTION APPROVING THE VOLUNTARY ANNEXATION OF PROPERTY, INCLUDING NON-CONSENTING PROPERTY,AND PROVIDING A TRANSITION FOR THE IMPOSITION OF TAXES WHEREAS,the City of Waukee,State ofIowa,is a duly organized municipal corporation,and; WHEREAS,the City of Waukee,Iowa has received Applications for Voluntary Annexation from the property owners of certain real estate under the ownership of said petitioners,located in Dallas County,Iowa,and shown on the map identified as Exhibit "A"attached hereto and made a part hereof and legally described as follows: LEGAL DESCRIPTIONS See Exhibit "B"attached hereto and made a part hereof. WHEREAS,pursuant to Chapter 368,Code ofIowa,2006,territory comprising not more than twenty percent of the land area has been included in the application without the consent of the owners to create more uniform boundaries and avoid the creation of and 'island,'and said properties are shown on the map identified as Exhibit "A"and legally described as follows: LEGAL DESCRIPTIONS See Exhibit "C",attached hereto and made a part hereof WHEREAS,such property collectively adjoins the City as required by Chapter 368,Code of Iowa,2006,and; WHEREAS,all required notification has been carried out pursuant to Chapter 368,code of Iowa,2006,and; WHEREAS,it is in the best interests of the City and public that said property be annexed to the City of Waukee,at this time. WHEREAS,the properties that are the subject of this annexation are currently zoned agricultural;and WHEREAS,pursuant to the Section 368.11 (m)ofthe Iowa Code (2006),the City Council desires to provide a transition for imposition of City taxes in accordance with the following formula:For the first and second years,seventy-five percent;for the third and fourth years,sixty percent.;for the fifth and sixth years,forty-five percent;for the seventh and eighth years,thirty percent;for the ninth and tenth years,fifteen percent.Each property annexed herein shall be eligible for said tax transitioning until such property is rezoned,not to exceed ten years. NOW THEREFORE,THE CITY COUNCIL OF THE CITY OF WAUKEE DOES RESOLVE AS FOLLOWS:ISECTION1.The Applications for Voluntary Annexation are hereby approved and said properties illustrated on the map attached as Exhibit "A"and legally described in Exhibits "B" and "C"shall be annexed to the City of Waukee Iowa,in accordance with Chapter 368,code of Iowa,2001,and such property shall hereinafter become and be part of the City of Waukee,Iowa. SECTION 2.The Mayor and City Clerk are hereby authorized and directed to prepare and execute all documents necessary for this annexation and are directed to file the same with the City Development Board as required by the Code ofIowa. SECTION 3.A transition for imposition of City taxes shall be provided to annexed properties, until the properties are rezoned,pursuant to Section 368.11 (m)Code of Iowa (2006)according to the following schedule: (1)For the first and second years,seventy-five percent. (2)For the third and fourth years,sixty percent. (3)For the fifth and sixth years,forty-five percent. (4)For the seventh and eighth years,thirty percent. (5)For the ninth and tenth years,fifteen percent. Said tax transitioning shall be applied in the levy and collection of City taxes in the armexation area for so long as the properties remain zoned as they are upon being annexed to the City,not to exceed 10 years. SECTION 4.This Resolution's transition for imposition of taxes shall be effective upon completion of annexation proceedings before the City Development Board;and thereafter,the City Clerk is hereby directed to file a copy of this Resolution with the Offices of the Dallas County Recorder,Auditor,Assessor,and Treasurer.
