RESOLUTION 10-19
APPROVING AND ACCEPTING WARRANTY DEED FOR
STREET LOTS B AND C OF ENTERPRISE BUSINESS PARI\:PLAT 1
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,Downing Development,LTD (the "Developer"),has previously submitted and
received approval of a final plat for Enterprise Bnsiness Park Plat 1 (the "Plat")(Resolution #95-
9);AND
WHEREAS,the public improvements associated with the Plat including the streets have
previously been accepted by the City (Resolution #96-4);AND,
WHEREAS,it has recently been brought to the attention of the City of Waukee that a warranty
deed for the previously accepted public streets had never been provided by the Developer;
NOW THEREFORE BE IT RESOLVED by the City Council of the City ofWauicee,Iowa on
this is"day of January 2010 that the warranty deed associated with the public streets within the
Plat is hereby accepted and approved by the City Council of the City of Waukee.
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to file the
warranty deed for the streets within the Plat,as well as any other documents related thereto,with
the Dallas County Recorder.
