RESOLUTION 10-26
APPROVING A NOTICE OF USE RESTRICTIONS IMPOSED BY STATE
ADMINISTRATIVE RULE ON CERTAIN REAL ESTATE,#08-R4-RN,RACCOON
RIVER VALLEY TRAIL -WAUKEE SEGMENT,CITY OF WAUKEE,DALLAS
COUNTY,IOWA
IN THE NAME AND BY THE A UTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,the City was awarded a Resource Enhancement and Protection (REAP)Grant,
dated September 10,2007,for the construction of the Raccoon River Valley Trail Extension;
AND,
WHEREAS,a provision of receipt of grant funding requires the City of Waukee to file an
agreement with Dallas County regarding the use of the property for its designated purpose as a
trail for a period of not less than 25 years;
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee that the
Notice of Use Restrictions Imposed by State Administrative Rule on Certain Real Estate,#08-
R4-RN,Raccoon River Valley Trail-Waukee Segment,is hereby approved,
Passed by the City Council of the City of Waukee,Iowa,and approved the 8th day of February
2010,
