RESOLUTION 10-44
APPROVING THE FINAL PLAT FOR LEGACY POINTE AT WAUKEE PLAT 6
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,Ewing Land Development &Services,L.L.C.(the "Developer")has requested
final approval of Legacy Pointe at Waukee Plat 6 (the "Plat");AND
WHEREAS,the City of Waukee Planning and Zoning Commission recommended approval of
the Plat on February 9,2010;AND,
WHEREAS,the Final Plat for Legacy Pointe at Waukee Plat 6 and the documents relating
thereto comply in all respects with Section §303 -Land Subdivision Ordinance ofthe Waukee
Municipal Code;
WHEREAS,public improvements associated with the Plat have not yet been constructed,
however,the Developer has entered into an Agreement with the City to complete the public
improvements;AND,
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Waukee,Iowa
on this 22nd day of Feb mary,2010 that the Final Plat for Legacy Pointe at Waukee Plat 6 be and
the same is hereby accepted and approved by the City Council ofthe City of Waukee subject to
final review and approval of the legal documents by the City Attorney.
BE IT FURTHER RESOLVED that the City of Waukee does hereby accept the following
additional easements to be filed with the Plat subject to final review and approval by the City
Attorney:
I.Easement for Public Utility;
2.Easement for Public Sidewalk;
BE IT FURTHER RESOLVED that the City of Waukee does hereby accept the Agreement to
Complete Public Improvements.
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to file the
final plat of Waukee Greenway Parle Plat 1,as well as any other documents related thereto,with
the Dallas County Recorder.
