RESOLUTION 10-53
APPROVING RENEWAL OF LEASE -BUSINESS PROPERTY BETWEEN THE CITY OF
WAUKEE,IOWAAND WAUKEE POST 737,THE AMERICAN LEGION,DEPARTMENT
OF iOWA,INC.(410 6TH STREET)
IN THE NAME AND BY THE A UTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City owns the property locally known as 410 6th St,Waukee,Iowa which the City
formerly offered for use as the Waukee Community Center;AND
WHEREAS,on April 6,2009,the City Council held public hearing and approved a Lease -Business
Property between the City of Waukee and the Waukee Post 737,the American Legion,Department of
Iowa,Inc.(the "Tenant")(Resolution #09-69);AND
WHEREAS,under the terms of the lease,the City shall have the option to annually renew the lease
for up to 2 renewals upon Tenant giving written notice of its intent to renew 120 days prior to the
expiration ofthe existing term;AND
WHEREAS,written notice from the Tenant was received on February 25,2010,which does not meet
the 120-day notice provision within the lease.
BE IT THEREFORE RESOLVED by the City Council of the City of Waukee that the Lease -
Business Property between the City of Waukee,Iowa and Waukee Post 737,the American Legion,
Department of Iowa,Inc.,shall be renewed for a term which shall commence on the 1st day of May,
2010,and ending at midnight on the 30th day of April,2011.
BE IT FURTHER RESOLVED that written notice received from the Tenant after the 120-day notice
provision within the lease does not preclude the City of Waukee or the Tenant from any other
provisions contained within the Lease -Business Property.
Passed by the City Council of the City of Waukee,Iowa,and approved this the 8th day of March,2010.
