RESOLUTION 10-80
APPROVING CONTRACT AMENDMENT NO.1 WITH
FOTH INFRASTRUCTURE AND ENVIRONMENT,LLC,FOR
ALICE'S ROAD IMPROVEMENTS,ASHWORTH ROAD TO UNIVERSITY AVENUE
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,ON August 18,2008,the Waukee City Council approved an Agreement for
Engineering Services by and between Foth Infrastructure and Environment,LLC,and the City of
Waukee related to Alice's Road Pavement Improvements,Ashworth Road to University Avenue
(Resolution #08-20 I);AND,
WHEREAS,it is proposed that the original Agreement be amended to include additional
services associated with Environmental Permitting,Geotechnical Exploration,and Right-of-Way
Services;AND,
WHEREAS,the Engineer's fee for the scope of the additional services is in the amount of
$96,000.00;AND,
WHEREAS,the City Attomey has reviewed the Amendment and has no objections.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee that the
Contract Amendment No.1 with Foth Infrastructure and Environment,LLC,for Alice's Road
Improvements,Ashworth Road to University Avenue,is hereby approved.
Passed by the City Council of the City of Waukee,Iowa,and approved the 5th day of April 2010.
