RESOLUTION 08-180
APPROVING THE SITE PLAN FOR LOT 1 OF THE CROSSING AT ALICE'S
ROAD PLAT 3 -TEAM TECHNOLOGIES
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized
Municipal Organization;AND,
WHEREAS,the City of Waukee Planning and Zoning Commission approved the Site
Plan for Lot I of The Crossing at Alice's Road Plat 3 -Team Technologies on July 8,
2008;AND,
WHEREAS,the Site Plan for Lot I of The Crossing at Alice's Road Plat 3 -Team
Technologies is in general conformance with §304 -Site Plan Ordinance of the
Waukee Municipal Code;
WHEREAS,the Site Plan for Lot I of The Crossing at Alice's Road Plat 3 -Team
Technologies has been proposed to be constructed in three (3)phases with the final
phase being completed by September I,2011;
WHEREAS,in order to accommodate efficient phasing for the project,the Owner
proposes that the west elevation of the building constructed in Phase I,and moved in
Phase 2,be exempted from the site plan requirement which require a minimum of70%
brick,stone or glass;
WHEREAS,the Owner has signed a Developers Agreement which provides for the
appropriate mechanism for assuring compliance with the City's site plan ordinance as it
pertains to the western elevation to allowing the owner the opportunity to phase the
project in a more efficient manner while at the same time assuring that in the event the
Owner fails to complete the phasing in a timely manner the western elevation of the
building will be brought into compliance with the City's site plan ordinance.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,
Iowa on this 21 st day ofJuly 2008 that the Site Plan for Lot I of The Crossing at Alice's
Road Plat 3 -Team Technologies is approved.
BE IT FURTHER RESOLVED that the City of Waukee does hereby accept the
Developmers Agreement related to the western building elevation.
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed
to file the Developers Agreement,as well as any other documents related thereto,with
the Dallas County Recorder.
