RESOLUTION 10-112
APPROVING AND ACCEPTING OVERLAND FLOWAGE EASEMENT FOR THE
DOUGLAS PARKWAY PAVING PROJECT (HERNDON BUILDING VENTURE)
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,it has been determined that an overland flowage easement is necessary for the
purpose of construction of the Douglas Parkway Paving Project;AND,
WHEREAS,said overland flowage easement shall be located on a portion of the property
owned by Herndon Building Venture,and legally described as follows:
THE NORTH 20.00 FEET OF THE SOUTH 53.00 FEET,EXCEPT THE WEST 60.00
FEEST THEREOF,OF PARCEL A AS SHOWN ON THE PLAT OF SURVEY
RECORDED IN BOOD 827,PAGE 321 AND BEING IN THE SOUTHWEST
QUARTER OF THE SOUTHWEST QUARTER OF SECTION 23,TOWNSHIP 79
NORTH,RANGE 26 WEST OF THE FIFTH PRlNCIP AL MERIDIAN,CITY OF
WAUKEE,DALLAS COUNTY,IOWA
WHEREAS,in lieu of payment related to said easement,all parties agree to the abandonment of
the existing septic tank and lateral field and the installation of a new septic tank and lateral field
on the property;
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
3'd day of May 2010 that it hereby approves the Overland Flowage Easement from Herndon
Building Venture,property owner within the Douglas Parkway Paving Project,with payment
made by the City to the property owner(s).
