RESOLUTION 10-111
APPROVING A LETTER OF UNDERSTANDING WITH HERNDON BUILDING
VENTURE REGARDING GRADING RELATED TO THE MITIGATION OF A LOW
WET AREA AND A DRIVEWAY APPROACH (DOUGLAS PARKWAY PAVING
PROJECT),PENDING SIGNATURES
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,on AprilS,2010,the Waukee City Council approved the adoption of plans,
specifications,form of contract and estimate of cost for the Douglas Parkway Paving Project
(Resolution #10-77);AND,
WHEREAS,as part of said project,the City of Waukee must obtain certain permanent and
temporary easements from property owners within the project area;AND,
WHEREAS,a Letter of Understanding is proposed between the City of Waukee and Herndon
Building Venture for the grading of a low wet area adjacent to the Douglas Parkway Paving
Project and the widening of a driveway at 3203 280lh Street;AND,
WHEREAS,the City ofWaulcee agrees,if feasible to engineer in the opinion of the Project
engineer,to lower the ditch on the north side of the Douglas Parkway Paving Project to drain a
low area at approximately stations 23 and 24.In the event that it cannot be done,the City also
agrees that if the low area does not drain to the ditch it will grade a swale from the ditch into the
low area;AND,
WHEREAS,as part of the Douglas Parkway Paving Project a 30-foot,18-inch culvert will be
installed at the driveway approach of3203 280lh Street.The City of Waukee agrees to widen the
width of that driveway approach as much as engineering feasible,in the opinion of the Project
engineer;AND,
WHEREAS,Herndon Building Venture agrees to grant the City of Waukee three (3)easements
related to the construction of the Douglas Parkway Paving Project.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
3'd day of May 2010 that it hereby approves the Letter of Understanding with Herndon Building
Venture regarding grading related to the mitigation of a low wet area and a driveway approach
(Douglas Parkway Paving Project),pending signatures.
