RESOLUTION 10-150
APPROVING THE SATISFACTION OF PROVISIONS AS SPECIFIED WITHIN THE
FINAL PLAT OF LEGACY POINTE AT WAUKEE PLAT 3
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,the City Council of the City of Waukee,Iowa approved the final plat for Legacy
Pointe at Waukee Plat 3 on October 18,2004 and recorded in Dallas County at Book 2004 Page
17220 ("Final Plat");AND,
WHEREAS,the approval of the Final Plat was contingent on the resolution oflanguage
permitting public access to Lot A;AND,
WHEREAS,the City of Waukee,Iowa was granted a Perpetual Recreation Trail Easement on
September 10,2009 which was approved by the City Council of the City of Waukee,Iowa on
September 14,2009 and recorded in Dallas County at Book 2009 Page 15686 which provides
public access to Lot A;
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,Iowa on
this the 17th day of May 2010 that the provisions of the approval relative to the final plat for
Legacy Pointe at Waukee Plat 3 have been satisfied,
