RESOLUTION 10-154
CLARIFICATION REGARDING PAYMENT ESTIMATE NO.1 FOR THE
WAUKEE PUBLIC WORKS FACILITY PROJECT IN THE AMOUNT OF
$151,907.20,AND PAYMENT ESTIMATE NO.2 FOR THE WAUKEE PUBLIC
WORKS FACILITY PROJECT IN THE AMOUNT OF $85,125.20,TO CLARIFY
THAT PAYMENT IN SAID AMOUNTS SHALL BE MADE TO CONSTRUCTION
SERVICES,INC.,TO BE DISTRIBUTED TO THOSE SUBCONTRACTORS LISTED
IN SAID PAYMENT ESTIMATES PURSUANT TO TERMS OF A CONTRACT BY
AND BETWEEN CONSTRUCTION SERVICES,INC.,AND THE CITY OF
WAUKEE
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State oflowa,is a duly organized
Municipal Organization;AND,
WHEREAS,on May 3,2010,the Waukee City Council approved Payment Estimates No.1
and No.2 related to the Waukee Public Works Facility Project;AND,
WHEREAS,due to a clerical error,the May 3,2010,City Council agenda made it appear as
though said payment would be made by the City of Waukee directly to the subcontractors
listed in said payment estimates;AND,
WHEREAS,a contract between project manager Construction Services,Inc.,and the City of
Waukee includes terms that payment estimates shall be paid directly by the City of Waukee to
Construction Services,Inc.,which shall in tum distribute the funds to the subcontractors listed
in payment estimates and in the amounts listed in the payment estimates;
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session
this 17'h day of May 2010 that clarification regarding Payment Estimate No.1 for the Waukee
Public Works Facility Project in the amount of $151,907.20,and Payment Estimate No.2 for
the Waukee Public Works Facility Project in the amount of$85,125.20,to clarify that
payment in said amounts shall be made to Construction Services,Inc.,to be distributed to
those subcontractors listed in said payment estimates pursuant to terms of a contract by and
between Construction Services,Inc.,and the City of Waukee,is hereby approved.
