HomeMy WebLinkAbout2009-07-06-Resolutions 09-141_Little Walnut Creek Culvert - Emergency RepairsTHE CITY OF WAUICEE,IOWA RESOLUTION 09-141 A RESOLUTION INSTITUTING OF EMERGENCY PROCEEDINGS UNDER IOWA CODE 384.103 (2009)AND APPROVAL OF AN AGREEMENT WITH MCANINICH CORPORATION CONCERNING EMERGENCY REPAIRS IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal Organization;AND, WHEREAS,the City experienced heavy rains throughout the month of June,which led to the collapse of storm sewer infrastructure under Little Creek Drive at or about its intersection with Warrior Lane in the City of Waukee,Iowa.The collapse led to a partial washout of Little Creek Drive which is presently a gravel road;AND, WHEREAS,the collapse of the sewer infrastructure and road washout pose an immediate danger to the traveling public,The dangers to the public are exacerbated even further by the potential for further washout of the roadway with very little rainfall due to the complete failure of the storm sewer infrastructure at this time under the roadway;AND, WHEREAS,Veenstra &·Kimm,licensed engineers,have certified that the emergency repairs are necessary and the City Council of the City of Waukee hereby fmds that the emergency work is necessary and institutes Emergency Proceedings pursuant to section 384.103 of the Iowa Code (2009);AND, WHEREAS,John Gibson,the public works director,has contacted three contractors to determine interest in availability for emergency work at Little Creek Drive and McAninich Corporation is the only contractor presently available in short order to assist in the completion of the emergency work. BE IT THEREFORE RESOLVED on this the 6th day of July 2009 by the City Council of the City of Waukee that the emergency work is necessary on Little Creek Dr.within the City and institutes Emergency Proceedings pursuant to section 384.103 of the Iowa Code (2009). BE IT FURTHER RESOLVED that the attached contract between the City of Waukee and McAninich Corporation is hereby ratified and approved.
