RESOLUTION 10-244
APPROVING ENTERING INTO A 28E AGREEMENT BETWEEN THE CITY OF
WEST DES MOINES,IOWA,AND THE CITY OF WAUKEE,IOWA,REGARDING
JOINT MAINTENANCE OF CERTAIN ROADS AND RIGHTS-OF-WAY WHICH ARE
UNDER THE JURISDICTION OF BOTH CITIES
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Iowa is a duly organized municipality within Dallas County;
AND,
WHEREAS,the purpose of this 28E agreement shall be to provide for the joint exercise of the
respective power of the Cities in the maintenance and servicing of several corporate line
roadways and lights-of-way in the respective Cities;AND,
WHEREAS,a ]oint Maintenance Agreement adopted by the City of West Des Moines on the
23'd day of December 2002 and by the City of Waukee on the 4th day of April 2003 (Resolution
#03-82)is hereby terminated and shall no longer be in effect upon the approval and acceptance
of this 28E agreement;
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council that the 28E
agreement between the City of West Des Moines,Iowa,and the City of Waukee,Iowa,regarding
joint maintenance of certain roads and rights-of-way which are under the jurisdiction of both
Cities is hereby approved.
Passed by the City Council of the City of Waukee,Iowa,and approved the 23Td day of August
2010 .
