RESOLUTION 10-296
APPROVING A CENTRAL lOW A REGIONAL DRINKING WATER COMMISSION
AMENDED AND RESTATED 28E AGREEMENT
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Iowa is a duly organized municipality within Dallas County;
AND,
WHEREAS,the City of Waukee is a dues paying member ofthe Central Iowa Regional
Drinking Water Connnission (CIRDWC);AND,
WHEREAS,the CIRDWC Board has determined that its 28E agreement should be modified
regarding source water issues,distinctions between dues paying and non-dues paying members,
staggered member terms and term lengths,reducing the number of members necessary for a
quorum,establishing a dues rate structure,and general provisions conforming with recently
revised bylaws;AND,
WHEREAS,any prior 28E agreements between the City of Waukee and the CIRDWC Board
are hereby terminated and shall no longer be in effect upon the approval and acceptance of this
28E agreement;
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council that the Central
Iowa Regional Drinking Water Connnission Amended and Restated 28E Agreement is hereby
approved.
Passed by the City Council of the City of Waukee,Iowa,and approved the 15th day of November
2010.
