RESOLUTION 11-55
APPROVING A RIGHT OF ENTRY AND INDEMNITY AGREEMENT BETWEEN THE
CITY OF WAUKEE AND THE IOWA DEPARTMENT OF NATURAL RESOURCES
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Iowa is a duly organized municipality within Dallas County;
AND,
WHEREAS,the Iowa Department of Natural Resources (IDNR)requests a Right of Entry and
Indemnity Agreement between IDNR representative Seneca Environmental Services and the City
of Waukee related to the environmental assessment and corrective actions associated with
underground storage tank contamination at 520 Walnut Street (former Olson Brothers Sinclair
Station)'AND,,
WHEREAS,the City Attomey has reviewed the proposal and has no objections;
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session tins
4th day of April 2011 that it hereby approves a Right of Entry and Indemnity Agreement between
the City of Waukee and the Iowa Department of Natural Resources.
