Awarding quote for the 2010 Sidewalk Improvements Program and
receiving and filing the quote for the 2011 Sidewalk Improvements
Program
WHEREAS,pursuant to notice duly published in the manner and form prescribed
by resolution of this Council and as required by law,quotes were received by the City
Clerk of Waukee,Iowa and reported to this Council for the 2010 and 2011 Sidewalk
Improvements Programs;and
WHEREAS,all of the said quotes have been carefully considered,and it is
necessary and advisable that provision be made for the award of the contract for the 2010
Sidewall,Improvements Programs;
WHEREAS,construction quotes were received by the City Clerk of Waukee,
Iowa and reported to this Council for the 2010 Sidewalk Improvements Program (the
"Project");and
WHEREAS,quotes were sought and received for engagement by the public for
sidewalk installation and repair in conjunction with the 2011 Sidewalk Improvement
Program;and
WHEREAS,the quotes for the 2010 and 2011 programs were to address the
installation of either 4 ancl/or 6 inch PCC paving,including ramps with truncated domes
and curb cuts for new installations in 2010 Zone,as well as the repair/replacement of
sidewalk panels,including ramp panels with truncated domes,throughout the City as
determined by the Public Works Department;and
WHEREAS,all of the said quotes have been carefully considered,and it is
advisable that provision be made for the acceptance of the quote for the 2010 Sidewalk
Improvement Program Project and the quote for the 2011 Sidewalk Improvement
Program should be received and filed.
NOW,THEREFORE,IT IS RESOLVED by the City Council of the City of
Waukee,Iowa,as follows:
Section 1.The quote for the 2010 Sidewalk Improvements Program
submitted by the following contractor is the lowest responsive,responsible quotation to
the plans and specifications for the Project,heretofore approved by the Council,and is in
the best interest of the City,such quote being as follows:

Section 2.The contract for the 2010 Sidewalk Improvements Program are
hereby awarded to the contractors named in above,at the respective total estimated costs
set out above,subject to approval of the final contract documents by the City Attorney,
execution of the same by Contractor and submission of contractors performance/payment
bond.
Section 3.The Mayor and City Clerk are hereby authorized to enter into
written contracts with said contractors for the Proj ect,said contracts not to be binding
until approved by resolution ofthis Council,
Section 4.The amount of each contractor's performance and/or payment
bonds is hereby fixed and determined to be 100%of the amount of such contractor's
contract.
BE IT FURTHER RESOLVED by the City Council of the City of Waukee,Iowa,
as follows
Section 1.The quote for the 2011 Sidewalk Improvements Program
submitted by the following contractor for sidewalk work to be performed within the City
is the lowest received by the City:

Section 2.The Quote is valid for 120 days from the date of notice to the
property owner for repair/maintenance work and September 15,2011 for new sidewall,
installation.Notice to property owners affected by the 2011 Sidewalk Improvement
Program shall include a notification of the existence of the aforementioned pricing for
work under the program,subject to arrangements being made between contractor and any
such property owner.The City shall not be obligated in connection with any such
arrangement.
Section 3.Contractor represents that he quote will be honored by contractor
for engagements received from private property owners within the City whose properties
are subject to the 2011 Sidewall,Improvement Program.
Section 4.The quote is received and filed however at this time,pursuant to
the 2009 Sidewall,Improvement Program Provisions,the City is not performing the work
as the affected property owners are given an opportunity for voluntary compliance with
the requirements of the program.Contractor may be engaged by private parties at their
own expense.
Passed and approved this 4[11 day of April,2011.
