RESOLUTION 11-78
APPROVING SETTLEMENT CONCERNING PROPERTY ACQUISITION FOR
THE 105TH STREET /ALICE'S ROAD INTERCHANGE PROJECT
IN THE NAME AND BY THE AUTHORiTY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized
Municipal Organization;AND,
WHEREAS,the City of Waukee and the City of West Des Moines have jointly pursued an
interchange across Interstate 80 known as the 105th Street /Alice's Road interchange,
pursuant to a 28E Agreement entered into between the Cities on February 11,2008;AND,
WHEREAS,pursuant to the Agreement the City of West Des Moines was the lead agency
for the acquisition of land necessary for the project;AND
WHEREAS,Oakleaf Properties,LC owned property on the Waukee side of the Interstate
which was acquired in furtherance of the project through eminent domain proceedings;AND
WHEREAS,West Des Moines was the lead agency for acquisitions as recommended in the
proposed settlement concerning the acquisition of the property owned by Oakleaf Properties,
LC as provided in the settlement agreement attached as exhibit A,AND
WHEREAS,the City Council of the City of Waukee having reviewed the proposal in
conjunction with the acquisition of certain property owned by Oakleaf Properties,LC and
having otherwise reviewed believes the same should be approved subj ect to approval by the
City of West Des Moines,Iowa.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council,subject to
approval by the City of West Des Moines,Iowa,that the proposed settlement associated with
property acquisition for tile 105th Street /Alice's Road interchange with Oakleaf Properties,
LC.is approved.
Passed by the City Council of tile City of Waukee,10 a,and approved tin the 9th day of
May,2011.

acquired througheondemnatlcn proceedings a parcel ofland owned by the Plaintiff.This
'parcelofland is fully described In the NotiteofCondenlrration datedDecember Z9,20.08 with
aEqulsjfionplatsattached.tllereto.(EXhibit,"A").,

Plaintiff.I1V court order dated March 24,ZIl09;the amount awarded by the Compensation
Commission was released to Plaintiff.

District COurt for Dallas COl.lntypursuantto 6B,18 and 6B.Z1 of the CQdeoflowa (2009).
4.Settlement.Whereas,priorto trial ofthlsAppeal,the parties have agreed upon
a mutually-satisfactory resolution of the Appeal and hereby memorialize their agreement In
writing,
IT ISTHEREFORE AGREED AS FOLLOWS:
5.":inalSettleroent Terms.In full and final settlement of the Appeal now pending
withtheIowa District Court,the parties agree to the folloWing:
(a)Payment,The Plaintiffagreestoaccepttheamount previously awarded

$535,000,00,for atotal cash award of One Million Six Hundred and Five
Thousand and·No/l00Dollars ($1;605;000,00).

movement access point at the northerly boundary of the plaintiff's
property where it is adjacent to the Allee's Road rlgl:tt-of-way,This fuU

In addition,based upon spaCIng.requirements,prelimlnary roadway
designs recommend a possible second access,located apprOXimately 500
feet south of the full n1Ovetrientlntersectlon.The second access is

Paragraph 5 as full and complete settleroentof all causes.claims;damages'arising out of or
