RESOLUTION DETERMINING AN AREA OF THE CITY TO BE
A BLIGHTED AND ECONOMIC DEVELOPMENT AREA,AND
THAT THE REHABILITATION,CONSERVATION,
REDEVELOPMENT,DEVELOPMENT,ORA COMBINATION
THEREOF,OF SUCH AREA IS NECESSARY IN THE INTEREST
OF THE PUBLIC HEALTH,SAFETY OR WELFARE OF THE
RESIDENTS OF THE CITY;DESIGNATING SUCH AREA AS
APPROPRIATE FOR URBAN RENEWAL PROJECTS;AND
ADOPTING AMENDMENT NO.1 TO THE WAUKEE UNIFIED
URBAN RENEWAL PLAN
WHEREAS,by Resolution No.93,adopted December 13,1988,this Council
found and determined that certain areas located within the City are eligible and should be
designated as an urban renewal area under Iowa law,and approved and adopted the
Waukee Urban Renewal Plan (the "Plan")for the Waukee Urban Renewal Plan Area (the
"Waukee Urban Renewal Area").The Waukee Urban Renewal Area was amended by
Resolution 00-226,adopted December 18,2000;further amended by Resolution 01-5 8,
adopted April 15,2001;further amended by Resolution 02-139,adopted September 23,
2002;further amended by Resolution 03-10,adopted January 6,2003;further amended
by Resolution 03-98,adopted April 21,2003;further amended by Resolution 04-159,
adopted July 12,2004;and further amended by Resolution 07-95,adopted May 21,2007;
and
WHEREAS,by Resolution No.197,adopted June 15,1992,this Council found
and determined that certain areas located within the City are eligible and should be
designated as an urban renewal area under Iowa law,and approved and adopted the
Waukee Southwest Urban Renewal Plan (the "Plan")for the Waukee Southwest Urban
Renewal Plan Area (the "Waukee Southwest Urban Renewal Area";and
WHEREAS,by Resolution No.335,adopted March 20,1995,this Council found
and determined that certain areas located within the City are eligible and should be
designated as an urban renewal area under Iowa law,and approved and adopted the
Enterprise Business Park Urban Renewal Plan (the "Plan")for the Enterprise Business
Park Urban Renewal Plan Area (the "Enterprise Business Park Urban Renewal Area");
and
WHEREAS,by Resolution No.04-272,adopted December 20,2004,this Council
approved and adopted an Amendment to Consolidate the Hickman West Urban Renewal
Area,Enterprise Business Park Urban Renewal Area,and the Waukee Urban Renewal
Areas and add property;and
WHEREAS,this Urban Renewal Area currently includes and consists of:

nine (79)North,Range Twenty-six (26)West,Fifth P.M.,City of Waukee,Dallas
County,Iowa.
Waukee Southwest Urban Renewal Area (1992)
A tract of land of portions of Government Lot 4 and Government Lot 5,all in
Section 5,Township 78 North,Range 26 West of the 5'h Principal Meridian in
and forming a part of the City of Waukee,Dallas County,Iowa,and more

WHEREAS,a proposed Amendment No.I to the Waukee Unified Urban Renewal
Plan for the area described below has been prepared,which proposed Amendment is on
file in the office of the City Clerk and which is incorporated herein by reference,the
plUpose of which is to:(1)unify all of the City's existing urban renewal areas into a
single area;(2)rename the unified areas the Waukee Unified Urban Renewal Area and
rename the Plan as the Waukee Unified Urban Renewal Plan;(3)add additional new
property for roads and future development,which property is designated as the
Amendment No.1 Area to the Waukee Unified Urban Renewal Area;(4)confirm the list
of urban renewal activities that may be undertaken by the City;and (5)designate a part of
the new area to be added as appropriate for the remediation of blight;and
WHEREAS,the proposed urban renewal does not include land classified as
agricultural land and,as such,no written permission of the current owners need be
obtained;and
WHEREAS,this proposed Amendment No.I to the Urban Renewal Area adds

Urban Renewal Area.
WHEREAS,it is desirable that these areas be redeveloped as part of the overall
redevelopment area covered by the proposed Amendment No.1 to the Waukee Unified
Urban Renewal Plan to be known hereafter as the "Waukee Unified Urban Renewal
Plan";and
WHEREAS,the Iowa statutes require the City Council to submit the proposed
Amendment No.1 to the Waukee Unified Urban Renewal Plan to the Planning and
Zoning Commission for review and recommendation as to its conformity with the general
plan for development of the City as a whole,prior to City Council approval thereof;and
WHEREAS,adoption of Amendment No.I to the Waukee Unified Urban
Renewal Plan has been approved by the Planning and Zoning Connnission for the City as
being in conformity with the general plan for development of the City as a whole,as
evidenced by its written report and recommendation filed herewith,which report and
recommendation is hereby accepted,approved in all respects and incorporated herein by
this reference;and
WHEREAS,by resolution adopted on April 18,2011,this Council directed that a
consultation be held with the designated representatives of all affected taxing entities to
discuss the proposed Amendment No.1 to the Waukee Unified Urban Renewal Plan and
the division of revenue described therein,and that notice of the consultation and a copy

of the proposed Amendment No.1 to the Waukee Unified Urban Renewal Plan be sent to
all affected taxing entities;and
WHEREAS,pursuant to such notice,the consultation was duly held as ordered by
the City Council and all required responses to the recommendations made by the affected
taxing entities,if any,have been timely made as set forth in the report of the Designated
Representative filed herewith and incorporated herein by this reference,which report is in
all respects approved;and
WHEREAS,by resolution this Council also set a public healing on the adoption of
the proposed Amendment No.1 to the Waukee Unified Urban Renewal Plan for this
meeting of the Council,and due and proper notice ofthe public hearing was given,as
provided by law,by timely publication in the Dallas County News,which notice set forth
the time and place for this hearing and the nature and purpose thereof;and
WHEREAS,in accordance with the notice,all persons or organizations desiring to
be heard on the proposed Amendment No.1 to the Waukee Unified Urban Renewal Plan,
both for and against,have been given an opportunity to be heard with respect thereto and
due consideration has been given to all comments and views expressed to this Council in
connection therewith and the public hearing has been closed.
NOW,THEREFORE,BE IT RESOLVED,BY THE CITY COUNCIL OF THE
CITY OF WAUKEE,STATE OF IOWA:
Section 1.That the findings and conclusions set forth or contained in Amendment
No.1 to the Plan concerning the area of the City of Waukee,State ofIowa,described in
the preamble hereof,be and the same are hereby ratified and confirmed in all respects as
the findings of this Council for this area.
Section 2.This Council further finds:
A.Although relocation is not expected,a feasible method exists for the
relocation of any families who will be displaced from the Waukee Unified Urban
Renewal Area into decent,safe and sanitary dwelling accommodations within
their means and without undue hardship to such families;
B.The Plan,as amended,and Amendment No.1 to the Waukee Unified
Urban Renewal Plan conform to the general plan for the development of the City
as a whole;and
C.Acquisition by the City is expected and as to those areas of open land to be
acquired by the City included within the Waukee Unified Urban Renewal Area:

1.Residential use is not expected,however,with reference to any
portions thereof which are to be developed for residential uses,this City
Council hereby determines that a shortage of housing of sound standards
and design with decency,safety and sanitation exists within the City;that
the acquisition of the area for residential uses is an integral part of and
essential to the program of the municipality;and that one or more of the
following conditions exist:
a.That the need for housing accommodations has been or will
be increased as a result of the clearance of slums in other areas,
including other portions of the urban renewal area.
b.That conditions of blight in the municipality and the shortage
of decent,safe and sanitary housing cause or contribute to an
increase in and spread of disease and crime,so as to constitute a
menace to the public health,safety,morals,or welfare.
c.That the provision of public improvements related to housing
and residential development will encourage housing and residential
development which is necessary to encourage the retention or
relocation of industrial and commercial enterprises in this state and
its municipalities.
d.The acquisition of the area is necessary to provide for the
construction of housing for low and moderate income families.
2.Non-residential use is expected and with reference to those portions
thereof which are to be developed for non-residential uses,such non-
residential uses are necessary and appropriate to facilitate the proper growth
and development of the City in accordance with sound planning standards
and local community objectives.
Section 3.That the Waukee Unified Urban Renewal Area,as amended,is a
blighted and economic development area within the meaning of Iowa Code Chapter 403;
that such area is eligible for designation as an urban renewal area and otherwise meets all
requisites under the provisions of Chapter 403 of the Code of Iowa;and that the
rehabilitation,conservation,redevelopment,development,or a combination thereof,of
such area is necessary in the interest of the public health,safety or welfare of the
residents of this City.
Section 4.That Amendment No.1 to the Waukee Unified Urban Renewal Plan of
the City of Waukee,State ofIowa,attached hereto as Exhibit 1 and incorporated herein
by reference,be and the same is hereby approved and adopted as "Amendment No.1 to

the Waukee Unified Urban Renewal Plan for the City of Waukee,State ofIowa";
Amendment No.1 to the Waukee Unified Urban Renewal Plan of the City of Waukee,
State of Iowa,is hereby in all respects approved;and the City Clerk is hereby directed to
file a certified copy of Amendment No.1 with the proceedings of this meeting.
Section 5.That the Waukee Unified Urban Renewal Plan and the Plan,as
amended,shall be in full force and effect from the date of this Resolution until the
Council amends or repeals the Plan,as amended.The proposed Amendment No.1 to the
Waukee Unified Urban Renewal Plan shall be forthwith certified by the City Clerk,along
with a copy ofthis Resolution,to the Recorder for Dallas County,Iowa,to be filed and
recorded in the manner provided by law.
Section 6.That all other provisions of the Plan not affected or otherwise revised
by the terms of Amendment No.1 thereto,as well as all prior Resolutions previously
adopted by this City Council be and the same are hereby ratified,confirmed and
approved in all respects.

INTRODUCTION AND BACKGROUND
The Waukee Urban Renewal Areas are all being amended to accomplish several
objectives:
1.Unifying all of the City's existing urban renewal areas into a single area.
The urban renewal areas being unified include the following:

This Amendment No.1 will provide updated information on such subjects as objectives,
types of renewal activities and financial information for the Unified Urban Renewal
Area.However,the provisions of the original Urban Renewal Plans are hereby ratified,
confirmed and approved and shall remain in full force and effect as provided therein,
except if the provisions are modified by or inconsistent with this Amendment No.1.
UNIFIED OR LINKED AREAS
In response to particular situations during the past years,the City of Waukee has created
and amended several urban renewal areas,covering different portions of the City.In
2004,the City linked certain areas together.This Amendment continues and confirms
the City's plan to link these urban renewal areas together.Changing economic conditions
and priorities makes it unnecessary to have separate areas.One of the objectives of
Amendment No.1 is to unify or link these areas in order to maximize the future
expenditure of incremental property tax revenues in order to promote economic
development.
The adoption of Amendment No.1 will have no effect on any of the tax increment
ordinances that have been adopted for any of the urban renewal areas,or on any of the tax
base valuations that have been previously established for any of the urban renewal areas
or amendment areas,
DISTRICT DESIGNATION
With the adoption of this Amendment No.1,the City of Waukee will continue to
designate the Waukee Unified Urban Renewal Area as an economic development area
that is appropriate for the promotion of commercial and/or industrial development.In
addition,the City is designating the sewage treatment plant and deteriorated public
works facility site as a blighted area,which exhibits conditions that constitute a serious
economic and social liability,and which impacts the sound growth of the City.The
sewage treatment plant and deteriorated public works facility are included in the
Amendment No.1 Area to the Waukee Unified Urban Renewal Area and are located
along 6th Street south of 300th Street,if 300th Street extended east across 6th street.The
property includes several structures used by the City's Public Works Department as well

as the 40 year-old sewage treatment plant.The existing structures that service the Public
Works Department that were constructed as metal pole bam buildings as early as 1980
and are anticipated to be abandoned by June 2011 due to deteriorated site and structures,
inadequate and faulty utilities including obsolete heating,plumbing and electrical
systems,and unsafe conditions.The deteriorated sewage treatment plant is anticipated to
be closed by 2017 due to an obsolete and ineffective system.
DESCRIPTION
The new property added by this Amendment No.1 to the Waukee Unified Urban
Renewal Area includes the right of way of various roads connecting the Area and the
existing Public Works/sewage treatment plant site.
The description of the Waukee Unified Urban Renewal Area,including the new property
being added as a result of this Amendment,is described in Exhibit A and illustrated in
Exhibit B and Exhibit B-1.
BASE VALUES
Each of the existing areas being unified as a result of Amendment No.1 will retain their
separate existing base values.
If Amendment No.1 is adopted and a Tax Increment Ordinance is effective prior to
December 31,2011,the area added as a result of this Amendment No.1 will have a base
value at the January 1,2010 level.
DEVELOPMENT PLAN
Waukee has a general plan for development outlined in the Waukee Comprehensive Land
Use Plan,adopted in 2008.This Urban Renewal Plan,as amended,is consistent with the
2008 Comprehensive Plan and the land use policy and priorities that were adopted as part
of the planning process.Specific objectives identified in the Comprehensive Plan
include,but are not limited to,a connected citizenry involving the creation of strong
civic gathering places;a successful and economically viable downtown;business
environments that defme our future through innovation and creativity;and mixed-use and
neighborhood integrated commercial developments which maintain a strong retail base
and are designed to be sustainable.

This Urban Renewal Plan does not change or in any way replace the City's current land
use planning or zoning regulation process.
PROJECT AREA OBJECTIVES
Renewal activities are designed to provide opportunities,incentives,and sites for
community economic development purposes,including new and expanded industrial and
commercial development,and blight remediation.Objectives include:
I.To stimulate through public action and commitment,private investment in
new commercial and industrial development.
2.To plan for and provide sufficient land for commercial or industrial
development.
3.To provide for the installation of public works and facilities in the Urban
Renewal Area,which ultimately contribute to the sound development of the
entire City.
4.To provide a more marketable and attractive investment climate.
5.To remediate blight in applicable areas.
6.To achieve a diversified,well-balanced economy providing a desirable
standard of living,creating job opportunities,and strengthening the tax
base.
TYPE OF RENEWAL ACTIVITIES
To meet the objectives of this Urban Renewal Plan and to encourage the development of
the area,the City intends to utilize the powers conferred under Chapters 403 and Chapter
15A,Code ofIowa.
1.To undertake and carry out urban renewal projects through the execution of
contracts and other instruments.

2.To acquire land and to provide for the construction of specific site
improvements such as grading and site preparation activities,access roads
and parking,fencing,utility connections,and related activities.
3.To arrange for or cause to be provided the construction or repair of public
infrastructure,including but not limited to,streets,water,storm sewer,
sanitary sewer,public utilities,sidewalks,street lights,public parks and
open spaces,bike trails,landscaping or other related facilities and activities
in connection with urban renewal projects.
4.To make loans,forgivable loans,tax rebate payments or other types of
economic development grants or incentives to private persons or businesses
for economic development purposes on such terms as may be determined
by the City Council.
5.To use tax increment financing to facilitate urban renewal projects,
including,but not limited to,financing to achieve a more marketable and
competitive land offering price and to provide for necessary physical
improvements and infrastructure,
6.To borrow money and to provide security therefor.
7.To make or have made surveys and plans necessary for the implementation
ofthe Urban Renewal Program or specific urban renewal projects.
8.To contribute to the elimination or remediation of blight through
contributions and/or incentives.
9.To assist with the operation,repair,and maintenance of the City-owned
golf course.
10.To acquire property through a variety of means (purchase,lease,option,
etc.)and to hold,clear or prepare the property for redevelopment,or to
dispose of property.
11.To use any or all other powers granted by the Urban Renewal Act to
develop and provide for improved economic conditions for the City of
Waukee and the State ofIowa.

PROPOSED PROJECTS
1.Certain urban renewal activities will continue over a period of years,such
as the construction of public infrastructure and incentives to encourage
increased employment and taxable value.The City may continue providing
direct or indirect financial assistance to private persons or businesses as an
incentive to locate or expand in the area.
2.The City-owned golf course may require funds for operations,maintenance
and repair.Availability of recreational/wellness facilities contributes to a
more productive community and attracts businesses and trained employees
in search of a high quality of life.The City recognizes a need to attract and
retain a workforce of adequate size so that existing and potential employers
will locate and expand operations within the City and the surrounding
region.Young people sometimes leave Iowa to relocate in areas that
provide opportunities for recreation and entertainment.The success of the
Sugar Creek Golf Course contributes to an attractive quality of life in the
City and the surrounding region.
3.Adequate sidewalks are also an important quality of life and economic
development component.With the emergence of the Complete Streets
movement (defined as providing infrastructure to facilitate all modes of
transportation including pedestrian and bicycles)and the promotion of
healthier lifestyles,it is important to provide an adequate,safe and
connected pedestrian way network to promote economic growth of the
City'S downtown and commercial/industrial development sites as well
promote interaction and movement within the community.Also,the City
continues to attract growing families as a source of employees for new and
existing employers.Such families demand safe and healthy foot and
bicycle transportation,
FINANCIAL DATA
Constitutional debt limit:$50,366,865
Current general obligation debt:$26,049,204
Proposed amount of loans,advances,indebtedness or bonds to be incurred.
Although a specific amount ofloans,advances,indebtedness or bonds to be

included for proj ects over time has not yet been determined,it is anticipated
that the cost of the proposed proj ects identified in the Proposed Proj ects of
this Plan Amendment will be in the $15-$20 million range.Depending on
the number and quality of businesses the City is able to attract over time,
that amount could increase to $30 million.In no event will debt be
incurred that would exceed the City'S debt capacity.It is further expected
that loans,advances,indebtedness or bonds to be incurred for the proposed
or subsequent projects,including interest on the same,will be financed in
whole or in part with tax increment revenues from the Urban Renewal
Area.
SPECIAL FINANCING
To meet the objectives of this Urban Renewal Plan Amendment and to encourage private
investment in and the development of the project area,the City may determine to provide
financial assistance to qualified private businesses through the making of loans,rebates
or grants under all applicable provisions of the Iowa Code,including bnt not limited to
Chapter 15 and 15A,and through the use of tax increment financing under Chapter 403
of the Code ofIowa.
1.Loan,Rebates or Grants.The making of loans or grants of public funds to
private businesses within the project area may be deemed necessary or
appropriate for economic development purposes and to aid in the planning,
undertaking and carrying out of urban renewal project activities authorized
under this Urban Renewal Plan and the Code of Iowa.Accordingly,in
furtherance of the objectives of this Urban Renewal Plan,the City may
determine to issue general obligation bonds,tax increment revenue bonds
or such other obligations or loan agreements for the pm-pose of making
loans or grants of public funds to private businesses located in the project
area.Alternatively,the City may determine to use available funds for
making such loans or grants.
2.Tax Increment Financing.The City may utilize tax increment financing as
a means to help pay for the costs associated with acquisition and the
development of the project area.General obligation bonds,tax increment
revenue bonds,internal loans or such other obligations or loan agreements
may be issued by the City,and tax increment reimbursement may be sought
for,among other things,the following costs (if and to the extent incurred by
the City):

a.Constructing public improvements,such as streets,sanitary sewers,
storm sewers,water mains or other facilities.
b.Making loans or grants to private businesses,including debt service
payments on any bonds or notes issued to finance such loans or
grants.
c.Providing the local matching share of state or federal grant and loan
programs.
d.Other authorized urban renewal projects.
Nothing herein shall be construed as a limitation on the power of the City to exercise any
lawful power granted to the City under Chapter 15,Chapter 15A,Chapter 403,Chapter
427B,or any other provision of the Code ofIowa in furtherance of the objectives of this
Urban Renewal Plan.
PROPERTY ACQUISITIONIDISPOSITION
The City may help finance the cost of land acquisition in the Area.The City will follow
applicable procedures for the acquisition and disposition of property.
RELOCATION
The City does not expect there to be any relocation required of residents or businesses as
part of the proposed urban renewal projects;however,if any relocation is necessary,the
City will follow all applicable relocation requirements.
STATE AND LOCAL REQUIREMENTS
All provisions necessary to conform to state and local laws will be complied with by the
City and the developer in implementing this Urban Renewal Plan and its supporting
documents,
SEVERABILITY
In the event one or more provisions contained in the Urban Renewal Plan,as amended,
shall be held for any reason to be invalid,illegal,unauthorized or unenforceable in any

respect,such invalidity,illegality,unauthorization or enforceability shall not affect any
other provision of this Urban Renewal Plan,and this Urban Renewal Plan shall be
construed and implemented as if such provisions had never been contained herein.
URBAN RENEWAL PLAN AMENDMENTS
This Urban Renewal Area Plan may be amended from time to time for a number of
reasons,including but not limited to,change in the area,to add or change land use
controls and regulations,to modify goals or types of renewal activities,or to amend
property acquisition and disposition provisions.The City Council may amend this Plan
pursuant to appropriate procedures under Iowa Code Chapter 403.
EFFECTIVE PERIOD
This Urban Renewal Plan Amendment No.1 will become effective upon its adoption by
the City Council and will remain in effect as a Plan Amendment until it is repealed by the
City Council.
The adoption of this Amendment will not impact the sunsets of any of the urban renewal
areas that are being unified or linked,except for the Waukee Southwest Urban Renewal
Area (Sugar Creek Golf Course).The Waukee Southwest Urban Renewal Area (Sugar
Creek Golf Course)had a self-imposed expiration date of June 30,2016.With the
adoption of this Amendment No.1,the City is eliminating the self-imposed expiration
date identified in the original 1992 Plan.However,the Council has elected that the sunset
applicable to the use of incremental property tax revenues or the "division of revenue,"as
those words are used in Chapter 403 of the Code of Iowa with regard to the original
Waukee Southwest Urban Renewal Area shall have the same sunset as the area being
added by Amendment No.1 to the Waukee Unified Urban Renewal Area,described in
the next paragraph.
With respect to any property added as a result of this Plan Amendment No.1,which is
included in an ordinance which designates that property as a tax increment area,the use
of incremental property tax revenues or the "division of revenue,"as those words are
used in Chapter 403 of the Code of Iowa,is limited to twenty (20)years from the
calendar year following the calendar year in which the City first certifies to the County
Auditor the amount of any loans,advances,indebtedness,or bonds which qualify for
payment from the incremental property tax revenues attributable to that property within
the Amendment No.1 to the Waukee Unified Urban Renewal Area.However,the use of
tax increment financing revenues (including the amount of loans,advances,indebtedness
or bonds which qualify for payment from the division of revenue provided in Section
-10 -
403.19 of the Code of Iowa)by the City for activities carried out under Amendment No.
1 to the Waukee Unified Urban Renewal Area shall be limited as deemed appropriate by
the City Council and consistent with all applicable provisions oflaw.
