RESOLUTION 11-121
APPROVING A RELEASE AND SATISFACTION FOR WAUKEE COMMUNITY
SCHOOL DISTRICT REGARDING PAYMENT FOR LA GRANT PARKWAY
IMPROVEMENTS
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized
Municipal Organization;AND,
WHEREAS,Bruce Carl Snyder,Sharon E.Hurst,Doug Smitley,James Hester,Dorothy
Hester,Jerry Hester,LeAnne Hester,Sherry Hester and Michael Telford (collectively
"Property Owners")entered into a Development Agreement ("Agreement")with the City of
Waukee,dated October 5,2007 and recorded on October 30,2007 in Book 2007 Page 16911,
Dallas County,Iowa regarding street improvements to LA Grant Parkway;AND,
WHEREAS,the Agreement required the Property Owners to pay to the City of Waukee the
sum of $359,910.63 on or before September 1,2017 or upon the sale or transfer of the
property,whichever shall first occur for the cost of the associated improvements to LA Grant
Parkway;AND,
WHEREAS,the Waukee Community School District has purchased the property from the
Property Owners and has made payment to the City of Waukee in the amount of $359,910.63
pursuant to the terms of the Agreement.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,Iowa
that the terms of the Agreement have been fully satisfied and tlle City releases the Property
Owners and Waukee Community School District,their successors and assigns,from all
obligations under said Developers Agreement and releases any and all mortgage and security
interests arising from said Agreement.
Passed by the City Council of the City of Waukee,Iowa,and approved this the 11t11 day of
July,2011.
