RESOLUTION 11-147
APPROVING THE VACATION OF PUBLIC BIKE TRAIL EASEMENT WITHIN
PARKVIEW CROSSING PLAT 6
IN THE NAME AND BY THE A UTHORlTY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly orgauized Municipal
Organization;AND,
WHEREAS,a Public Bike Trail Easement ("Easement")was approved as a part ofthe final plat
for Parkview Crossing Plat 6 and recorded in Book 2005 Page 173 within Dallas County,Iowa to
allow for the construction of a future bike trail across Lots 111 and 112 of'Parkview Crossing
Plat 6;AND,
WHEREAS,as a part of further construction and platting of Lots 111 and 112 ofParkview
Crossing Plat 6,the proposed trail has been moved to run parallel to SE Parkview Crossing
Drive;AND,
WHEREAS,the City of Waukee no longer has a need for the Easement across Lots 111 and
112 of Park view Crossing Plat 6 which is legally described as:
THE EAST 30 FEET OF LOT 111 AND THE EAST 30 FEET AND NORTH 30 FEET
OF LOT 112 OF PARKVIEW CROSSING PLAT 6,AN OFFICIAL PLAT IN
WAUKEE,IOWA,DALLAS COUNTY.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
8th day of August,2011,that it hereby approves the vacation of the Public Bike Trail Easement
across Lots 111 and 112 of Park view Crossing Plat 6,
