RESOLUTION 11-185
A RESOLUTION PURSUANT TO IOWA CODE §364.12(2)(A),CLOSING THE ALLEY
BETWEEN 520 AND 530 WALNUT STREET FOR ADJACENT TO THOSE
PROPERTIES.
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,an alley exists between the properties located at 520 and 530 Walnut Street within
the City of Waukee,Iowa;AND,
WHEREAS,the property owner of the property at 520 and 530 Walnut has requested the
vacation of the alley,however,city utilities continue to run in the alley way making it preferable
for the city to retain access to the utilities in the alley as well as maintain the possibility of
reopening the alley to vehicular traffic should circumstances warrant;AND,
WHEREAS,all property owners within the block in which this particular alleyway is located
have been notified of the City'S consideration of this request a proposed action and invited to
attend the Council meeting to provide comment concerning the closure of this portion of the
alley way on the block;AND,
WHEREAS,there exist other alleyways serving the other properties on the affected block;
AND,
WHEREAS,this portion of the alley way does not exclusively serve the requesting properties
any longer due to street expansion and any use by vehicular traffic of the alley way adjacent to
those properties due to the condition of the alley and proximity of private structures to the alley
way is likely disruptive and may be hazardous to pedestrians and patrons ofthe businesses
fronting Walnut St;AND,
WHEREAS,pursuant to §364.12(2)(a),Public ways and grounds may be closed by resolution of
the City Council.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
26th day of September,2011,that it hereby approves the temporary closing of the Alley way
between the properties located at 520 and 530 Walnut,along and adjacent to the property lines of
those properties,to unauthorized vehicular traffic until further resolution e City Council.
