RESOLUTION 11-177
APPROVING THE SALE OF REAL PROPERTY LEGALLY DESCRIBED AS
LOT 5 OF CLAYTON COMMONS PLAT 1 AND AUTHORIZING THE MAYOR
TO SIGN DOCUMENTS ON BEHALF OF THE CITY OF WAUKEE RELATED
TO THE SALE OF SAID PROPERTY
IN THE NAME AND BY THE AUTHORiTY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Iowa is a duly organized municipality within Dallas
County;AND,
WHEREAS,on September 8,2011,the City of Waukee received an offer from Greg
Marean of Marean Construction to purchase Lot 5 of Clayton Commons Plat 1 for
$31,000 with a $1,000 down payment and the balance to be paid prior to construction of a
home on the lot in Fall 2011;AND,
WHEREAS,on September 26,2011,the Waukee City Council held a public hearing
pursuant to Code ofIowa §364.7 regarding the sale of property legally described as Lot 5
of Clayton Commons Plat 1;AND,
WHEREAS,at said public hearing,there were no comments made regarding the
proposed sale of real property.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in
session this 26th day of September 2011 that it hereby approves the sale ofproperty
legally described as Lot 5 of Clayton Commons Plat 1 to Marean Construction in the
amount of $31,000.00 with a $1,000 down payment and the balance to be paid prior to
construction of a home on the lot in Fall 2011.
BE IT FURTHER RESOLVED by the City of Waukee City Council that it hereby
authorizes Mayor William F.Peard to sign any and all documents on behalf ofthe City of
Waukee as they relate to the sale of property legally described as Lot 5 of Clayton
Commons Plat 1.
