RESOLUTION 11-194
ACCEPTING WARRANTY DEED FROM ST.BONIFACE CATHOLIC
CHURCH
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized
Municipal Organization;AND,
WHEREAS,St.Boniface Catholic Church signed a development agreement on January
18,2000 which included amongst other things,provisions for the acquisition of right of
way for the future extension of University Avenue;AND,
WHEREAS,the City of Waukee is completing plans for the construction of a fiber
optics line through the proposed right of way for University Avenue adjacent to St.
Boniface Church;AND,
WHEREAS,St.Boniface has signed a Warranty Deed for the transfer of the proposed
right of way for the future University Avenue extension pursuant to the terms of the
Development Agreement which will aid in the construction of the fiber optic project.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in
session this 10th day of October,2011,that it hereby accepts such Warranty Deed and the
City Clerk is hereby authorized to file such Warranty Deed with the Dallas County,Iowa
Recorder.
