RESOLUTION 11-209
APPROVING THE SALE OF REAL PROPERTY LEGALLY DESCRIBED AS LOTS 2,
3 AND 4 OF CLAYTON COMMONS PLAT 1 AND AUTHORIZING THE MAYOR TO
SIGN DOCUMENTS ON BEHALF OF THE CITY OF WAUKEE RELATED TO THE
SALE OF SAID PROPERTY
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Iowa is a duly organized municipality within Dallas County;
AND,
WHEREAS,on September 28,2011,the City of Waukee received an offer from Ryan T.Beattie
of Altoona,IA,to purchase Lots 2,3 and 4 of Clayton Commons Plat I for $30,000 each,with a
10%security deposit made within ten (10)working days of acceptance of the offer by the City of
Waukee and the balance to be paid within forty-five (45)days of acceptance of the offer by the
City of Waukee;AND,
WHEREAS,on October 24,2011,the Waukee City Council held a public hearing pursuant to
Code ofIowa §364.7 regarding the sale of'property legally described as Lots 2,3 and 4 of
Clayton Commons Plat I;AND,
WHEREAS,at said public hearing,Greg Marean of Marean constructed presented a separate
offer for purchase of Lots 2 and 3 of Clayton Commons Plat I and the City Council chose to
table action on the resolution until additional discussion could be had with Mr.Beattie.
WHEREAS,Mr.Beattie has submitted an amended offer to purchase Lots 2,3 and 4 of Clayton
Commons Plat 1 for $31,000 for Lots 2 and 3 and $32,000 for Lot 4 with a 10%security deposit
made within ten (10)working days of acceptance of the offer by the City of Waukee and the
balance to be paid within forty-five (45)days of acceptance of the offer by the City of Waukee.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
7'1.day of November 2011 that it hereby approves the sale of property legally described as Lots
3,4 and 5 of Clayton Commons Plat 1 to Ryan T.Beattie in the amount of$31,000 each for
Lots 2 and 3 and $32,000 for Lot 4 of Clayton Commons Plat 1,with a 10%security deposit
made within ten (10)working days of acceptance of the offer by the City of Waukee and the
balance to be paid within forty-five (45)days of acceptance of the offer by the City of Waukee.
BE IT FURTHER RESOLVED by the City of Waukee City Council that it hereby authorizes
Mayor William F.Peard to sign any and all documents on behalf of the City of Waukee as they
relate to the sale of property legally described as Lots 2,3 and 4 of Clayton Commons Plat I.
