HomeMy WebLinkAbout2011-11-07-Resolutions 11-205_Urban Renewal Plan Amendment 2 - Set PHRESOLUTION NO.11-205 RESOLUTION SETTING DATES OF A CONSULTATION AND A PUBLIC HEARlNG ON A PROPOSED AMENDMENT NO.2 TO THE WAUKEE UNIFIED URBAN RENEWAL PLAN IN THE CITY OF WAUKEE,STATE OF IOWA WHEREAS,by Resolution No.93,adopted December 13,1988,this Council found and determined that certain areas located within the City are eligible and should be designated as an urban renewal area under Iowa law,and approved and adopted the Waukee Urban Renewal Plan (the "Plan")for the Waukee Urban Renewal Plan Area (the "Waukee Urban Renewal Area").The Waukee Urban Renewal Area was amended by Resolution 00-226,adopted December 18,2000;further amended by Resolution 01-58, adopted April 15,2001;further amended by Resolution 02-139,adopted September 23, 2002;further amended by Resolution 03-10,adopted January 6,2003;further amended by Resolution 03-98,adopted April 21,2003;further amended by Resolution 04-159, adopted July 12,2004;and further amended by Resolution 07-95,adopted May 21,2007; and WHEREAS,by Resolution No.197,adopted June 15,1992,this Council found and determined that certain areas located within the City are eligible and should be designated as an urban renewal area under Iowa law,and approved and adopted the Waukee Southwest Urban Renewal Plan (the "Plan")for the Waukee Southwest Urban Renewal Plan Area (the "Waukee Southwest Urban Renewal Area");and WHEREAS,by Resolution No.335,adopted March 20,1995,this Council found and determined that certain areas located within the City are eligible and should be designated as an urban renewal area under Iowa law,and approved and adopted the Enterprise Business Park Urban Renewal Plan (the "Plan")for the Enterprise Business Park Urban Renewal Plan Area (the "Enterprise Business Park Urban Renewal Area"); and WHEREAS,by Resolution No.04-272,adopted December 20,2004,this Council approved and adopted an Amendment to Consolidate the Hickman West Urban Renewal Area,Enterprise Business Park Urban Renewal Area,and the Waukee Urban Renewal Areas and add property;and WHEREAS,by Resolution No.11-80 adopted on May 23,2011,this Council approved and adopted Amendment No.1 to the Waukee Unified Urban Renewal Plan in order to:(1)unify all of the City's existing urban renewal areas into a single area;(2) rename the unified areas the Waukee Unified Urban Renewal Area and rename the Plan as the Waukee Unified Urban Renewal Plan;(3)add additional new property for roads and future development,which property is designated as the Amendment No.1 Area to -1 - the Waukee Unified Urban Renewal Area;(4)confirm the list of urban renewal activities that may be undertaken by the City;and (5)designate a part of the new area to be added as appropriate for the remediation of blight;and WHEREAS,this Urban Renewal Area currently includes and consists of: Waukee Urban Renewal Area (1988) The Northwest Quarter (NW Y.)of Section 'Ihirty-fivc (35),Township Seventy- nine (79)North,Range Twenty-six (26)West,Fifth P.M.,City of Waukee,Dallas County,Iowa. Except as modified by this Amendment No.2,the provisions of the Plan,as previously amended, shall remain in full force and effect. DISTRICT DESIGNATION With the adoption of this Amendment No.2,the City of Waukee is designating the Area included within the Amendment No.2 which was a former fire station and water plant as a blighted area,because it exhibits conditions that constitute a serious economic and social liability,and which impacts the sound growth of the City.The former fire station and water plant is located at 355 7'''Street.The property includes an approximately 2,700 square foot brick structure constructed in 1966 which is vacant and has been vacant for the last six months.The building is currently in a state of deterioration including broken or boarded windows,a deteriorated roof structure and inadequate and faulty utilities including obsolete heating, plumbing and electrical systems,and unsafe conditions as well as combined sanitary/storm sewers,The property also includes remaining remnants and underground structures associated with the water plant.The property also suffers from inadequate parking and deteriorated adjacent public streets and storm water infrastructure. DESCRIPTION The new property added by this Amendment No.2 to the Waukee Unified Urban Renewal Area includes a 0.24 acre parcel of ground locally known as 355 7th Street, The description of Amendment No.2 to the Waukee Unified Urban Renewal Area is described in Exhibit A and illustrated in Exhibit B. -22- BASE VALUES If Amendment No.2 is adopted and an ordinance providing for a division of taxes is effective prior to December 31,2011,the area added as a result of this Amendment No.2 will have a base value at the January 1,2010 level. LAND USE PLANNING AND ZONING Waukee has a general plan for the physical development of the City outlined in the Waukee Comprehensive Plan.The goals and objectives of this Amendment are consistent with the goals and land use policies in the Comprehensive Plan,which were identified and adopted as part of the planning and zoning process. PROPOSED PROJECTS The City of Waukee anticipates redevelopment and remodeling of the property designated within Amendment No.2 for a new Community Center which is intended to serve a number of functions including a meeting and gathering location for the senior citizen comrmmity within the City of Waukee as well as for purposes of a multi-purpose hall intended to be utilized for both public functions including use in coordination with City festivals and events as well as provide a venue for citizens and local groups to rent for private events and functions.The project also entails the rehabilitation of a small City park space as well as the addition of public on-street parking meant to serve the new Community Center. The City of Waukee also adds the following activities as an authorized project under this Plan,as amended. Support for economic development entities that assist and foster economic development activities within the Urban Renewal Area,as amended,including but not limited to: •planning,providing or conducting surveys,studies,and other information •planning and work necessary to prepare for the undertaking of urban renewal projects; •assisting with grants and Iunds from state and local governments; •aiding in the planning or carrying out of urban renewal projects; •providing administrative and other services to the City related to increased economic development activities,including the retention and creation of employment -23 - FINANCIAL DATA Constitutional debt limit:$52,386,072 Current general obligation debt:$26,318,940 The Proposed Proj ects identified as a part of this Amendment is anticipated to cost approximately $400,000-$500,000.The City intends to use tax increment revenues or reimbursement from tax increment revenues to fund the Proposed Proj ect.In no event will debt be incurred that would exceed the City's debt capacity.It is further expected that loans,advances,indebtedness or bonds to be incurred for the proposed or subsequent projects,including interest on the same,will be fmanced in whole or in part with tax increment revenues from the Urban Renewal Area. SEVERABILITY In the event one or more provisions contained in the Urban Renewal Plan,as amended,shall be held for ally reason to be invalid,illegal,unauthorized or unenforceable in any respect,such invalidity,illegality,unauthorization or enforceability shall not affect any other provision of this Urban Renewal Plan,and this Urban Renewal Plan shall be construed and implemented as if such provisions had never been contained herein. URBAN RENEWAL PLAN AMENDMENTS This Urban Renewal Area Plan may be amended from time to time for a number of reasons, including but not limited to,change in the aTea,to add or change land use controls and regulations,to modify goals or types ofrenewal activities,or to amend property acquisition and disposition provisions.The City Council may amend this Plan pursuant to appropriate procedures 1111derIowa Code Chapter 403. EFFECTIVE PERIOD Tins Urban Renewal Plan Amendment No.2 will become effective upon its adoption by the City Council and will remain in effect as a Plan Amendment until it is repealed by the City Council, With respect to any property added as a result of this Plan Amendment No.2,which is included in an ordinance which designates that property as a tax increment area,the use of incremental property tax revenues or the "division of revenue,"as those words are used in Chapter 403 of the Code ofIowa,is unlimited because of the designation of Plan Amendment No,2 as "blighted."
