APPROVING THE ENGINEERING SERVICES AMENDMENT NO.2 BETWEEN THE CITY
OF WAUKEE,IOWA AND FOTH INFRASTRUCTURE AND ENVIRONMENT,LLC,
RELATED TO THE ALICE'S ROAD CORRIDOR,ASHWORTH ROAD TO UNIVERSITY
AVENUE PROJECT
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized Municipal
Organization;AND,
WHEREAS,the City of Waukee has previously entered into an Agreement for Engineering Services
with Foth Infrastructure and Enviromnent,LLC for services related to the Alice's Road Corridor,
Ashworth Road to University Avenue Project on August 18,2008;AND,
WHEREAS,the City has asked for additional services relative to wetland delineation and topographic
survey related to storm water management improvements that are connected with the Alice's Road
Corridor paving proj ect.
NOW THEREFORE BE IT RESOLVED by the City C0111lcil of the City of Waukee that the
Engineering Services Amendment No.2 related to the Alice's Road Corridor,Ashworth Road to
University Avenue Project,attached hereto as Exhibit A,is hereby approved.
Passed by the City Council ofthc City of Waukee,Iowa,and approved the 21 st day of November 2011.

ENGINEERING SERVICES AMENDMENT NO.2

THIS AMENDMENT,made and entered into this 11;\-day of November 2011 by and between,the CITY
OF WAUKEE,IOWA,hereinafter referred to as the "City",and FOTH INFRASTRUCTURE AND ENVIRONMENT,LLC.,
hereinafter referred to as the "Engineer",for professional servlces in connection with the conceptual development traffic
review and analysis,preliminary survey and mapping,preliminary design,final plans and specifications.farthe proposed
construction of Alices Road from Ashworth Road to just south of Universjty Avenue,hereby amends the original
Agreement dated August 18'",2008 as follows:
The City and Engineer agree to amend the original Agreement to include additional services associated with the expanded
project limits for weather sensitive field work related to the initial development of the Alices Road Green Belt from
immediately downstream of Alices Road (near Station 154+00 to east property line of Ashworth Properties)to just
upstream of Alices Road (ncar Station 196+00 -Giles Properly)and include the follOWing tasks:
TASK A -Wetland Delineation Services:
Wetland delineation services were completed in 2008 and 2010 for the Alices Road and sanitary sewer corridors.The
purpose of this service will be to characterize the existing site conditions,to determine the extent of waterbodies and
wetlands on the proposed greenbelt,and to provide a recommendation regarding whether the identified waterbodies or
wetlands would be considered jurisdictional by the U.S.Army Corps Engineers (USACE).The development oftheAlices
Road Greenbelt will require delineation of approximately 130 acres.
The delineation will use mandatory technical criteria,field indicators,and other sources of information to determine
·whether the project area has jurisdictional WUS orwetlands.The classification will be performed bya degreed biologist or
environmental scientist.If wetlands are present,the upland boundaries within the project area will be identified.
The methods the Engineerwill use in thedclineation generally follow the Regional Supplement to the Corps of Engineers
Weiland Delineation Manual:Midwest Region (2010)and the Federal Manual for Identifying and Delineating Jurisdictional
Wetlands (1987).Jurisdictional wetlands generally have three essential characteristics:hydrophytic vegetation,hydric
soils,and wetland hydrology.
Wetland delineation Scope of Work includes the following:
Assemble and review application and available information (i.e.,aerial photographs,soil classifications
and soil survey maps,USGS topographic maps.National Wetland Inventory (NWl)maps).
Perform an on-site visit to gather data pertaining to the hydrophytic vegetation community,surface
hydrology,and hydric soil characteristics.Tile following items will be performed at discrete data point
locations within suspect wetland areas on-site and will be characterized on appropriate wetland
determination data forms for inclusion in the report.
o Assess each stratum of vegetation (Le.,trees,saplinqs/shrubs,herbs,and woody vines).
Vegetation will be classified by Genus species and dominance will be determined.
o Classify soil types and evaluate hydric soil indicators using shallow soil probes or space holes.
o Observe site characterlsflcs for wetland hydrology Indicators.
Utilize a Trimble GeoXT GPS (sub-meter accuracy)hand-held unit to map the location and boundaries
of delineated wetlands.If heavy tree cover is present,a non-GPS survey may be needed to identify
welland boundaries.Fees for standard surveying have not been included in this proposal.
Prepare maps showlnq the delineated wetland area(s)and identified WUS.

This wetland delineation task includes one site visit to conduct a baseline delineation.Under the rvlidwestSupplement,on
specific sites the USACE may request that the three wetland criteria be evaluated over time to provide additional
information regarding seasonal changes in the wetland boundaries andlor characteristics.If the USACE requests
additional information.the Engineer will provide additional scope for the City approval prior to conducting the work.
This task does not include Wetland Mitigation Services or Phase I or Phase II Archeological Investigations.
Subtotal-$8,800.00
TASK B -Greenbelt Topographic Survey:
The Engineer with conduct field surveys to obtain the topographic data,ground elevations,and cross sections required for
the development of the proposed Greenbelt (area to be less than 200 acres +1-)and to supplement the existing mapping
available from the City.This task also consists of incorporating the topographic features,profiles,and cross sections into
the base mapping for the project.
The Engineer will contact the various utility companies and collect available information on underground utilily locations
and incorporate such available utility information into the base mapping of the project.Utilities to be rese-arched include
sanitary sewer,storm sewer,electric,gas,water,telephone,cable television,and fiber optic lines.
The Engineer will research City,County,and State records to establish locations of pr~perty lines,rjght~of~way lines,and
property ownership for the properties affected by the project and incorporate this data into the base mapping of the
project.
Subtotal-$16,700.00
In consideration for these services,the-City agrees to adjust the compensation for services performed by the Engineer.
These fees are based on the standard hourly rates of the Engineer's personnel actually enqaqed in the performance of the
services,plus direct out-of-pocket costs for expenses incurred by personnel who are actually engaged in the work and
other direct costs.The total Hourly Nut-to-Exceed fees for the professional engineering services as described in this
amendment are as follows:

THIS AMENDMENT is subject to all provisions of the original Agreement
THiS AMENDMENT.together with the original Agreement represents the entire and integrated AGREEMENT
between the City and Engineer.
