RESOLUTION 12 -43
APPROVING THE SALE OF REAL PROPERTY LEGALLY DESCRIBED AS LOTS 6,
7,8 AND 9 OF CLAYTON COMMONS PLAT 1 AND AUTHORIZING THE MAYOR
TO SIGN DOCUMENTS ON BEHALF OF THE CITY OF WAUKEE RELATED TO
THE SALE OF SAID PROPERTY
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Iowa is a duly orgauized municipality within Dallas Couuty;
AND,
WHEREAS,on February 2,2012,the City of Waukee received an offer from Mere Loan LLC
(Country Estates Realty),to purchase Lots 6,7,8 and 9 of Clayton Commons Plat 1 for $29,000
each for Lots 6-8 and $26,500 for Lot 9,with a $5,000 non-refundable eamest deposit to be
applied towards the purchase of the fourth lot;AND,
WHEREAS,on February 7,2012,the City of Waukee received a higher offer from Marean
Construction for Lot 9 of Clayton Commons Plat 1 for $28,500;AND,
WHEREAS,on February 27,2012,the Waukee City Couucil held a public hearing pursuant to
Code ofIowa §364.7 regarding the sale of property legally described as Lots 6,7,8 and 9 of
Clayton Commons Plat 1;AND,
WHEREAS,after the public hearing,Mere Loan LLC (Country Estates Realty)verbally
submitted an amended offer to purchase Lots 6,7,8 and 9 of Clayton Commons Plat 1 for
$31,000 each with a 10%security deposit made within ten (10)working days of acceptance of
the offer by the City of Waukee and the balance to be paid within forty-five (45)days of
acceptance of the offer by the City of Waukee.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
27'h day of February,2012,that it hereby approves the sale of property legally described as Lots
6,7,8 and 9 of Clayton Commons Plat 1 to Mere Loan LLC (Couutry Estates Realty)in the
amouut of $31 ,000 each,subj ect to the buyer submitting an amended written offer.
BE IT FURTHER RESOLVED by the City of Waukee City Council that it hereby authorizes
Mayor William F.Peard to sign any and all documents on behalf of the City of Waukee as they
relate to the sale of property legally described as Lots 6,7,8 and 9 of Clayton Commons Plat 1.
