RESOLUTION 12-67
APPROVING SATISFACTION OF AGREEMENT TO COMPLETE PUBLIC
IMPROVEMENTS FOR THE CROSSING AT ALICE'S ROAD PLAT 3
WHEREAS,approval of the fmal plat for The Crossing at Alice's Road Plat 3
(the "Plat")has previously been given by resolution of the Waukee City Council on July
21,2008 (Resolution 08-178);and
WHEREAS,at the time of approval of the fmal plat,certain public
improvements within the Plat were not completed,and the City and Alice's,L.C.(the
"Developer")entered into an Agreement to Complete Public Improvements -The
Crossing at Alice's Road Plat 3,dated July 21,2008 (the "Agreement");and
WHEREAS,the Agreement was recorded with the Dallas County,Iowa
Recorder on August 19,2008 in Book 2008,Page 11528;and
WHEREAS,the public improvements associated with the Plat were completed
and were accepted by the Waukee City Council on August 17,2009 (Resolution 09-
170).
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL,CITY OF
WAUKEE,IOWA:
I.That the obligations of Developer with respect to The Crossing at Alice's
Road Plat 3 under the Agreement are hereby declared to be satisfied.
2.This resolution shall be filed of record with the Dallas County,Iowa
Recorder.
Passed by the City Council of the City of Waukee,Iowa,and approved this the 2nd day
of April,2012.
