RESOLUTION 12-126
RESOLUTION APPROVING AN AMENDMENT TO DEVELOPERS AGREEMENT
RELATED TO LOT 2 OF WINDFIELD COMMERCIAL PLAT 1 -CRAIG DENTAL
CLINIC
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,the City entered into a developer's agreement ("Agreement")with Craig Dental
Center,PC,an Iowa professional corporation ("Developer")recorded in Book 2009 at Page
12732 of the Dallas County,Iowa Recorder's Office regarding shared access and a common
driveway out to SE Laurel Street associated with the development of Lot 2 of Windfield
Commercial Plat 1;AND,
WHEREAS,the City required as a part of the Agreement,security related to the costs associated
with the construction of the common driveway out to SE Laurel Street which Developer
provided;AND,
WHEREAS,as a part of the development of Lots 3 and 4 of Wind field Commercial Plat 1,the
shared access to SE Laurel Street was constructed and security for the improvement is no longer
necessary.
THEREFORE,the Developer and the City,in consideration of the foregoing and other good
and valuable consideration agree to amend the Agreement by removing and deleting paragraph 4
of said Agreement.With the exception of the modification provided herein,the Agreement
remains in effect.
BE IT THEREFORE RESOLVED by the City Council of the City of Waukee on this 21st day
of May,2012,that the amended Agreement to remove paragraph 4 is hereby approved.
BE IT FURTHER RESOLVED the City Clerk shall cause the amended development
agreement to be recorded upon the property by submitting the original to the Dallas County
Recorder's office with the appropriate recording fees~~
