RESOLUTION 12-173
APPROVING THE CERTIFICATE OF COMPLETION FOR CERTAIN PROPERTY
(EWING LAND DEVELOPMENT)
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,the City of Waukee and Ewing Land Development &Services,L.L.C.entered into
a Development Agreement recorded in Book 2003,Page 14968 and as amended in Book 12005
Page 7586 regarding the development of property known as Legacy Pointe;AND,
WHEREAS,the Company has performed the obligations of the Development Agreement
insofar as they relate to the following portion of the Legacy Pointe Development:
Lot 1 in Legacy Pointe at Waukee,Plat 6,an Official Plat,City of Waukee,Dallas
County,Iowa;and
Lot 2 in Subdivision of Lot 19 Legacy Pointe at Waukee Plat 1,an Official Plat,City of
Waukee,Dallas County,Iowa;and
Lot 11 in Legacy Pointe at Waukee Plat 4,an Official Plat,City of Waukee,Dallas
County,Iowa;and
Lot 1 of Subdivision of Lot 19 Legacy Pointe at Waukee Plat 1,an Official Plat,City of
Waukee,Dallas County,Iowa.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,Iowa on
this 6th day of August,2012 that the Certificate of Completion for Certain Property (Ewing Land
Development)be approved.
